i all would just like to ask any moderators or members on line if i should send in a previously completed ib 50 form from last year. what i mean is i completed the ib 50 form last year and passed without having to attend a medical examination. my circumstances are exactly the same as last year i can only give them the same answers to there same repeated questions they are asking me. i would be greatful for any feed back thank you all

Hi,

Providing answers are still relevant I would copy your answers from your old copy to the new one. Only you know if your condition has changed or not and your answers on the new IB50 should reflect this.

However there is no guarantee that you will/will not be called for a medical even if your answers are identical.

Pete

Hi

I have all my answers on my computer and just check the questions haven't changed (which they had slightly for me on my last IB-50) print them out and then glue them on to the form. This has always been accepted and it also means that they don't have to read my dreadfull handwriting!!

So as Pete says if your condition hasn't changed and the question is exactly the same then use your answers from last time. They can still call you to a medical if they think it is necessary. Also I believe that they also do a random sample of people called for a medical as well.

Thank you for the reply's i recieved to my question.I will complete the IB 50 form again with the same answer's as i gave the previouse year and hope for the best.I do not want to add thing's to the form that would be untrue eg my condition as got worse or my condition as improved like i've said i can only state that my condition's are exactly the same as last year. also i would like to ask if i did have to go to a atos medical and failed and i did have to appeal would the appeals board take into account previouse medical evidence such as passing the medical twice previously thank's again

Hi,

An appeal panel would probably consider the most contemporary medical evidence as that would 'help' ascertain your claim to benefit as you currently are.

You could introduce the previous medical evidence but it would be upto the panel as to whther or not they accept that it is still relevant (they would only have your word for it as it stands unless you can introduce your own upto date medical evidence in corroboration). In anycase should you need to be going to an appeal tribunal you should really seek face to face advice from a welfare rights adviser, who can go through all the evidence with you to decide what is and isn't helpful to you and present the best case.
