It's very bad news! I have been refused PIP for both mobility and care! My DLA will be stopped 21/03/17

My partner has also received a letter stating that his carer's allowance will be stopped on 21/03/17

Firstly, i know i have to ask for a mandatory reconsideration and then i can appeal!

My worry in the meantime is that together with my partner David we have lost £807.40 a month plus the decision letter states that as we get free vehicle tax because of DLA, once my DLA ends on 21/07/17 we will have to tax the vehicle! I have also have a blue badge and a free bus pass. What happens to them?

Please can you advise me as to what i can claim for in the meantime or what financial help i can get. We also have a mortgage to pay!

I'm really sorry to hear of this result.

I would get in touch with your local CAB office as soon as you can, there are unfortunately no substitute benefits for PIP, they can help you claim whatever other benefits that may be available.

I believe your bus pass ends as soon as your DLA does, but you should be able to continue to use the Blue Badge but I would contact you Local Authority to confirm this.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

Hi Gordon,

Thank you for your advice below.

I have sent off my mandatory reconsideration last thursday! I went to my local CAB and spoke to DIAL. I cannot claim anything else.

We are now left with my partner and I both living off my contribution based ESA!

DIAL have also confirmed that after 21/03/17 I can still use my blue badge and also my bud pass.

I can't afford to run my car anymore and will be housebound!

Have you looked into income-related ESA? You could be entitled if you and your partner have no income other than the contributory ESA. The amount of extra money might not be huge but it would bring automatic entitlement to things like free prescriptions.

I also have a small medical pension from work. We already get free prescriptions under low income category. Thank you for your advice. Could my partner get income support as now with his carers allowance stopped, he has no money coming in?

Income Support is far more difficult to get than it used to be. It is unlikely that your partner will be entitled to this if he is not in receipt of Carers Allowance :(

Try putting your details into one of the benefit calculators to see if there is anything else you might be able to claim.
