Thanks, yes, sorry I meant 10 points, not 12, I was getting confused again. Having looked at the decision letter again, I think I'm basically out of time to send in a written submission as it takes me absolutely ages to be able to do anything, even the most minor of tasks and im in a really bad place at the moment.

Would i be able to phone to try to request a mandatory reconsideration and follow it up with something in writing? Or would the written part not then be accepted out of time? I would have asked someone to phone/help me but I now no longer have this. Typical of me, to spend so long worrying about something and being so indecisive, that time trickles away and runs out..

When you say to try to argue that cannot does not mean never, could I just ask what you mean by the 'reliability rules'? Thanks again for your help

Although we don't recommend it, you can phone in your request for an MR, make it clear that you want time to provide extra evidence and that you need time to do this, they should allow you an additional four weeks, but try not to take all of that time if you can.

The reliability rules are explained in the PIP Claim guide, they are one of the most important aspects of PIP so forgive me if I find it a little worrying that you have not heard of them.

Thanks. I had heard of the reliability terminology, in fact I think I confused myself by probably trying to read too much by way of the change in descriptors and court ruling etc.The more I tried to read, the more confused I got. I was just hoping you could give me examples or pointers on reliability to do with this specific descriptor and my particular problems...? I am still going through a terrible bereavement at the moment and so am completely overwhelmed with worry, grief and stress. I just cant see a way out. I haven't been out in so long, I currently have no support and am struggling to want be here at all. I just didn't know how best to express things if I asked for a reconsideration. Even the idea of contacting them, or anyone in authority, fills me with dread. Can i ask, when they say you have to request a consideration within one month, how specific is that e.g. 30 or 31 days? I am just asking as I think im most likely out of time but then maybe that might be a good thing, as I don't think I'm really mentally capable of challenging it. Everything is such a struggle for me.

It's a calendar month so for a Decision made today 12/07, the DWP would have to have received your MR request by 11/08, however, you can make a Late request up to 13 months later, but you must provide Good Cause for it being late and if this is not accepted by the DWP then you cannot take the matter further, although it would be unusual for them to do this.

Hi, sorry to be asking you about this again but my head is just so scrambled and still can't get my head around things. Can I clarify with you... i received the report after putting in a mandatory reconsideration by telephone, due to time restraints. According to that, I was assessed under the older/original descriptors for mobility (going out) but according to what you said before, am I right in saying that it makes no difference in my case if I wanted to try to qualify for c) or d) planning and following journies? I.e. does the change in terminology by adding 'for reasons other than psychological distress' just mean they have clarified the descriptor, rather than actually changed it? Thanks

As far as I can see from your previous posts the Decision on your claim was made using the new Descriptors.

You have only mentioned problems such as Agoraphobia in regard to your Mobility problems, you have not mentioned any cognitive or sensory problems which would effect your ability to follow or navigate a route.

If you have problems leaving your house then I would expect you to only score for Descriptors (b) and (e).

To score for (d) and (f) you will need to show that you cannot follow or navigate a route, this is seen as primarily an issue of cognitive or sensory failure.

You may be able to argue that anxiety created by a physical problem (other than walking) could affect your cognitive ability to such an extent that it would prevent you following the route, but if the problems are due to a mental health problem then you won't score points.
