Hi all,
Surprise surprise I actually received my report today thx to my postman recognizing my name on the envelope, as the DWP put the wrong house number on the envelope, fortunately there was no such number in my road or some1 else would be reading it now unless they sent it back of cause.
I will post later when I have read through it

Hi All
Well I've had a good read throught the report and the first thing I noticed the Assessor wrote in the social and occupational history that I drink alcohol. I specifically said I do NOT drink alcohol or smoke. not that that would make any difference but it's the principle of it.
she also wrote in the odservations section that I walked at a balanced slow pace with adnormal gait
But in the DWP decision letter they put I walked aided, slowly with a balanced gait.
it also said I was observed walking 20 metres from the reception to clinic room without stopping or with breathlessness, fatigue or pain.
As I said before it wasn't 20 metres and we did stop because we had to stop for her to open a door to go through halfway there and I was in a lot of pain but as I said not everyone can show their emotions.
Because of this she decided to tick the 20 metres but no more than 50 metres box, when it should of been the 1 metre but no more than 20 metres box which I had ticked.

Also on the planning and following journey section I ticked yes to needing help beause I need someone with me if I go out because I am at risk of falling and causing harm to myself or others because at the bottom of that question it states (need someone to be with you to keep you safe), that was overlooked and I got no points for that one,
because it went on about you have no dianosed cognitive and learning or sensory impairment, no specialist mental health no meds for anxiety and because you reported you drive.
but none of that was the reason why I ticked the yes box.
I explained why I needed someone with me to the assessor but it seems to have gotten overlooked and not wrote in her report.

So just on those points would I have any chance of a reconsideration, not sure how to word it exactly.
I have had a look through the reports in the member guides but I'm stuck at the moment.
Any help appreciated. Thanks

It's difficult to comment on your walking distance, 20m is actually quite a short distance.

You are not required to walk pain free but any pain that restricts the distance that you can walk should be taken into account.

Specifically for the Moving Around activity, if you are able to walk but you are in severe pain when doing so, then you can argue that your walking is not to a necessary standard and should be disregarded.

The legal test requires you to stand and then move (walk), so if you have problems getting up then you should document these as well.

If you walk slowly then it must take you at least twice the time to cover the 20m as a healthy person would, this could be down to the speed of your walking but could also be the result of having to stop.

You must be able to repeat the distance, so if you could walk it once but not then be able to walk it again within a reasonable timescale then you should be classed as unable to repeat the activity.

I'm afraid I can't tell you how to show your walking is more restricted but things you need to think about is what you can't do, for example what can you walk in your house, how far is the toilet from where you normally sit, things that will count against you are any trips that you make outside, so for example, how do you do your shopping?

As to Going Out, this activity does not directly deal with physical problems, these are considered under the Moving Around activity. Your only route to points due to your balance problems is for you to show that the risk of falling causes you anxiety and that anxiety is so great that it would effect your cognitive ability to navigate a route. As you do not seem to receiving any treatment or medication for anxiety it may be difficult for you to show this.

Thanks for your response,
I would not of been able to repeat the walk again if she had asked me too.
I have cervical myelopathy, I was told if I didn't have an operation on my neck I would end up paralyzed from the neck down as my spinal cord was being compressed.
I had 2 disc's taken from my neck and bone taken from my hip and fused in cages to the bone in my neck.
Since there was scaring already on my cord my legs remained the same and I have difficulty walking, I suffer with the pain in my neck which radiates down my left shoulder and arm, I have constant numbness and pain in my legs and the longer I am on them the harder it is to walk and it is really painful I also have constant vibrating in my feet and a constant ache in my right leg and foot and a pain in my groin which gets worse as I walk. my balance is shot,
I also have a bulging disc in my lower back which makes matters worse and I have arthritis in my hands.

I have just had my appointment to go back to see a neurology consultant finally come through so I will send them that as well now I have a date.

I currently receive high rate mobility and medium rate care indefinitely in DLA so it is going to make a big difference when it drops to the new award.
I wouldnt mind but when I was working I was earning £52000 a year and that was 12 years ago and then that just went over night with my illness.
For me being told I would never work again and that I would have to take medical retirement hit me like a ton of bricks.

There was one part of the report from DWP I was a bit confused about and that was at the end it reads,
I cannot consider any help you need not covered by the activities for daily living and mobility, including abiiility to work.
Are they implying that I can go back to work regardless of what my consultant said ?

I just think it is disgusting what they are doing to people especially people who are worse off than myself.

From this, it sounds as if you (or your consultant) told DWP about your problems with work and in other areas not covered by the PIP descriptors. The DM was simply saying that they can only consider information that relates to the descriptors.

Forgot to mention my toilet is 27 feet from where I sit, my kitchen is 12 feet, the toilet from my bed is 14 feet, I do my shopping online and have it delivered I don't cook, my kids do that for me on a daily basis when they visit I have 4 grown up kids who take turns coming around so I'm lucky there. I rarely go out the house unless it's to an appointment.
