esa assessment and home visits was created by Lazylizard
hi,
I requested a home call visit for assessment for esa and got my doctor to fax through to them to also request this, weeks later I receive a letter saying I must attend an assessment at their building in town. I got a text from the benefits today reminding me I should attend the assessment so I assume the home visit isn't going to happen..
My question is because I don't attend the assessment I assume they will then see that and cut my benefits, do I have the right to argue against this in a tribunal? purely on the basis that I didn't even attend the assessment? or must I attend the assessment and fail for then to have the right to question that?
thanks

Welcome to the forum, you might want to have a look at the following FAQ which explain where everything is
Welcome to Benefits and Work
In case you are not aware, your real name appears to be showing in the forum, if you want to change this then follow the instructions in the following FAQ
My full name is showing, how can I stop it?
If you fail to attend the assessment without Good Cause then your claim will be closed, any challenge that you make to the Decision will be solely concerned with your reasons for not attending and not whether you qualify for ESA or not.
Be aware that you will not be entitled to any ESA payments while you undergo this process and even if successful you will still need to attend a new assessment, which may not be in your home.

From your original post it looks like Maximus have decided that you are capable of attending at their offices, the DWP will undoubtedly take the same view.
