In brief I have full PIP both parts, husband had DLA mobility but lost it in September. We are awaiting btribunal but letter from court today says there is still a large backlog. We have been paid severe disability premium and have found out that we were not entitled to it after one partner lost claim. We now have very little to come in and a huge amount to pay back. My husband is thinking of applying for Carer's allowance but I wondered if his PIP is reinstated could he come off Carer's allowance?

Providing he is able to provide you with a minimum of 35 hours of care a week then he can claim CA, this can be backdated by at least three months and may help with any overpayment that you have received.

If you were receiving the Severe Disability Premium then you must also be receiving an Income Related benefit such as ESA(IR), Income Support or Pension Credit. The CA will be treated as income so there will be no net increase in your benefits but you will also receive a Cares Premium that will increase your weekly payments.

If his PIP is reinstated then you have two options, continue with the CA and receive the SDP for his claim or close the CA claim and receive SDP for both of you, the latter will provide more money, but there may be other reasons to consider the first option depending on the benefits that you are receiving, I would recommend that you get face to face advice at that time.
