An appeal and a Tribunal are the same thing.

You are taking three completely separate processes and lumping them all in together.

A claimant is assessed to see whether they meet the requirements for a benefit, typically they will provide information about their situation and this be assessed by a qualified person to see whether they meet the criteria or not. This results in a Decision as to whether they are entitled to an award and at what level.

If the claimant is unhappy with the Decision, no award is made or they believe they meet the criteria for a higher award, then then appeal the Decision. This is a two stage process, first the DWP re-evaluate the evidence available to see whether an error was made in the making of the original Decision, this is called a (Mandatory) Reconsideration.

If the claimant is still unhappy with the Decision then they can appeal it to the Tribunal Service. A Tribunal panel will look at all of the information collected for the assessment and any additional evidence that the claimant submits to see whether they agree with the original Decision and if they don't then they will substitute their own Decision.

None of the above two processes involve the claimant being followed or covert access to their banking information.

If the DWP receive information that a claimant is not compliant with the terms of their benefit then they will launch either a compliance or fraud investigation, the latter may include surveillance and the collection of financial information, it usually doesn't and only authorised staff are able to do this.

Thank you Gordon. That's really helped me and calmed my neurosis. I've had my home visit this week,difficult to say how it went lasted about hour and half, had great difficulties understanding what he was asking due to eastern Asian accent, spoke very quickly and into his lap top rather than my face.
I had to keep getting him to repeat things, he messed with his phone twice! can they covertly record assessment.

kept stopping me from explaining my point.
He was very aggressive.
I don't even know his name? he showed me no Identification?.
my son sat in next room and listened to whole thing and couldn't believe how aggressive he was an how he was deliberately trying to make me change my answers .
He then came to the moving around question, an he was seriously rushing now, he made me walk five metres.
my husband measured it that night and the assessor said so you can probably walk up to twenty metres which is different to more than? But he then said but you've got a big house so you probably can do twenty metres, he kept muttering , I didn't know what he was saying he wouldn't let me expand on this topic, he just extremely quickly packed up an fled literally. So all in all I'm not feeling confident about outcome. Who and how do I request copy of this report from Gordon and should I do so? Will the fact I'm already requesting it look like I'm defeated , do they secretly film visit? His laptop had an unusual external red light facing me built into device, I said are you filming the interview but I couldn't understand his reply, he set up a special desk 2 foot in front of me and had to sit on my foot poof , I said why don't you sit on sofa only 4 foot to my side, he said he had to be facing me to see what I was doing? Talk about intimidation? I wanted to laugh at this point. So I'm not feeling confident about things right now

The assessor video taping the assessment would be a serious breach of professional ethics which could easily lead to them being dismissed so I doubt very much that they did this.

Thanks Gordon, I'm just having a meltdown at the mo with all this , making me ill. However the way he sat in front of me like he did is that normal ? And the constant messing with his phone ?? . Have others reported such practices?? I found the whole thing very unprofessional, when I think of the fantastic health practitioners that have looked over me an still do , it's totally dispiriting to have things come to such standards , don't you agree? He didn't even tell me anything about when I may hear outcome, he refused to read my evidence I'd collated and refused to take it with him? . I just can't believe my future lies in the hands of a stranger who is more motivated to work for money than practice their qualified health professions. Says it all really don't you think.. ironic eh.. Sorry I'm just venting my frustration. Xx
