Hi,
I have received my MR with no change.
This is after a pip review which has seen my award go from HR care to no care.
I have lots of evidence, etc , this is due to the new HP opinion. Nothing has changed in my condition. Near the bottom of the MR notice is a paragraph about me receiving carers allowance for my son who has autism, and how this isn't compatible with my own difficulties. None of my difficulties stop me caring for my son, his needs are supervision and prompting based, he is on long term DLA. What are your thoughts on this? When I first applied for pip, I did ask them about myself and the carers allowance and I was told this was fine. It seems now, that this is being held against me. I would be interested in your thoughts on this. I do feel that I should go to appeal because our issues are completely different, and this is evident from my pip form and his DLA form.

HI Mrs J,

I am sorry, but not surprised, that your MR did not decide in your favour. It is uncommon for them to do anything other than 'rubber stamp' the original decision.

It is perfectly possible for 2 people in receipt of DLA/PIP to claim CA for each other.

However, as you have found, some people do find it difficult to believe that someone with mainly physical problems can give care in the form of support/prompting to someone with mental health issues (and vice versa).

In order to show your entitlement for PIP, you will need to explain clearly the kind of care you give and how/why it does not contradict the claims you have made on your PIP2 form. The Tribunal panel will want to assess your case from scratch themselves, they will pay less attention to the assessors' report than what you tell them about your limitations.

Our PIP guide has links to the form you will need to initiate the appeal. You do not need to include a lot of information at this stage. We recommend that you do not complete ypour own submission until you have seen DWP's - but you should start thinking about it and making notes so that you are ready when the time comes.

May I suggest that you bookmark/favourite this on your web browser now so that you can find it easily in future? This will allow you to return with further questions or comments about your appeal without having to start a new topic each time. We ask members to keep everything relating to the same claim in one topic as it helps us enormously - and I hope you will find it useful too :)

When I apply for the appeal, do you think the care I give to my son, etc, should be on the appeal form, or should I wait for when I make my submission? What I'm asking is, do I have to give all this information now, or at a later date?

Hi,I have looked through my MR notice. One of the points I made in my MR letter was that the AP report had been audited, and that the edited version had spelling and grammatical errors, there was mention of a specialist doctor letter that had a ridiculous date on, i.e. in the future? I said that the edited version was just as unfit for purpose.In my MR letter, the DM has written that the AP report was not edited, and there were a number of reasons why the report would be completed by another person on another date.
He also stated that the specialist letter noted on the report was dated incorrectly and was not used in the justification of the activities.
My questions are, I know the report was audited, ATOS told me when I enquired, so what would the DM be talking about?
Also if the wrongly dated report was not used, and I sent in a lot of evidence, would this be a point I should be making in my SSC1 form? That I don't believe that the decision maker has made use of my medical evidence, and I still don't know what this letter is?
I was also considering writing that my caring duties towards my son do not conflict with the difficulties on my PIP2 form. My MP is supposed to be writing a supporting letter with regards to the care part. Do you think this might help?
Im just asking for opinions really, I know its hard to comment on things like this.
