ESA claim was created by Perdita
I was not given sufficient information by central Benefits Enquiries which means I missed out on a claim for ESA. This goes back to 2013/14. I have been advised by welfare rights advisers to write a letter of complaint to the local job centre. Also to maybe put a claim in now backdating to Dec 15 (my last work day) if my GP will do a fit note and to put a note on the claim form saying that i was ill advised, hence the late claim. Am I best off to just do the letter of complaint or should I do the letter of complaint and also put in a claim(the claim will probably be rejected on the grounds of being too late).

On the ESA form you have to give your landlord's address. I do not intend claiming housing benefit and will be paying my rent myself My landlord may not want a tenant who is a DSS tenant. Do the DWP always contact the landlord during an ESA claim, I don t want my landord to be contacted.

Your making a complaint would be an entirely separate activity from any claim for ESA that you might make, especially as it does not relate to a current claim.

You can make a backdated claim for ESA by up to three months, providing it is supported by a Fit Note.

I'm afraid I do not know if the DWP will contact your landlord about your ESA claim, unfortunately this is not an area of ESA that we advise on.
