My answer is simple, don't go there!

Relying on a Judge to overturn a DWP Decision about deprivation of Capital is, forgive me, foolish in the extreme.

Get proper advice about whether you can do this legally, if you can then fair enough, if you can't then don't do it.

HI, started ESA claim end March, finally processed 19th May and letter received confirming ESA payment amount whilst in assessment phase. However I cannot get to grips with when I should receive ESA50. Maximus and DWP give conflicting info. At one point DWP were saying Maximus send out the ESA50 but Maximus were saying DWP send out the ESA50. Eventually after asking again it seems DWP do definitely refer case over to Maximus which then triggers Maximus to send ESA50. However I am not sure at what point DWP send case over to Maximus, I cannot get a straight answer although I know my case has not been referred to Maximus yet because Maximus have no record of me. I do not know whether I should keep pestering DWP about when my case will be referred. I am fed up with all the different versions I get to hear from them regarding the system. The last person I spoke to said the first thing I will receive will be an appointment for Health and Work Conversation at the Job Centre. This is meant to be happening in week 4 of the claim. She said it was a new thing that started in April. My local welfare rights advisor said he had heard nothing about such a thing despite having attended a recent DWP update meeting.

Do you think my case should have been referred by now or do the referrals to Maximus take many months?( I know the actual medical assessments can be long time coming)

Have you heard of the Health and Work Conversation interview?

An ESA50 should be issues in week 4 or 5 of the claim, so you are several weeks short of this, I do not know how soon after Maximus receive the claimants file that this occurs, there is what is called a pre-board check on whether a form needs to be issued in the first place. My best guess if that the receive in at the beginning of week 4 as the check would not take long and there is unlikely to be much of a queue in this part of the process as there is the assessment part, once the form is returned.

The Health and Work Conversation, it used to be called a Work Focussed Interview is also schedule for weeks 4-5.

Also, sorry to bombard you with questions, I will not be able to attend any sort of interview at the Job Centre required in week4/5. My social worker
has already suggested I ask my psychiatrist to write a letter saying I would not be able to attend. I have been wondering whether I should ask for such a letter now ready or whether to wait for the appointment letter??? Also I am sure my psychiatrist would do the letter and pass it to me, is it the DWP ESA Post Handling Site he should put at the top of the letter ?
