I'm not saying that you cannot score the points, but you will only do so by showing that you meet the criteria.

The underlying requirement for the familiar and unfamiliar journeys is now being taken as an inability to navigate, I'm afraid "guiding you to safety" is unlikely to be considered as coming under this heading.

Your husband accompanying you, I'm afraid re-enforces the prompting score and the CAB saying that you "cannot undertake any journey" is contradictory to you saying that you go out 3/4 times a month.

You need to reconcile these issues and explain why you meet the criteria for 10 points, but to do this you must show that you suffer from "overwhelming psychological distress".

Right ok.

Well I cannot go out the MAJORITY of the time due to overwhelming psychological distress. But sometimes i have to go to appointments and I do have 3/4 every month. So I cannot meet that descriptor.

The unfamiliar journeys very rarely happen but I don't think I could argue my husband navigates me. Although it's likely I would experience a lot of anxiety and panic going on a unfamiliar journey which makes me feel disorientated and unsafe. Think that's why it was given at tribunal but now as you say. That has changed so I doubt it would stand now.

I wouldn't want to argue the moving around question as I probably do walk over 200 metres on the odd occasion despite being in a lot of pain and having to take time to recover.

I actually think from hearing all this my cab adviser did not realise the descriptor for the unfamiliar journey had changed as he was certain I should ask for a reconsideration and score for that descriptor.

I think I should now not ask for a reconsideration as it would seem even though prompting is definately not the right term to use. The 4 points I have for the going out question is all I deserve.

Out of curiosity if I speak to the decision maker (well my husband on my behalf) and discuss his decision. Can you still send a written MR or would talking to him be classed as that? X

Before you make a decision, you need to remember that the only visibility that I have of your issues is what you post on the forum, the issues I am raising are ones that I think it reasonable that the DM would consider, but that does not mean your counter arguments cannot be successful either at MR or appeal.

Your talking to the DM on the phone should not be considered as being your MR, but if you are worried about this then just make it clear at the start of the call, that you reserve the right to still request an MR after the call.

Ok thank you Gordon.

1 last question....

I currently get pip enhanced care standard mobility that runs out on 6th may. I was awarded on 20th April the same.
The letter says I will get £148.71 paid into my account on 17th May to cover 7th may to 16th may. Then I'll be paid every four weeks in arrears.
Thing is I was due to get £400 ish on the 10th May. I take it that isn't happening now.
So so confused. Xxx

If that is what you have been told then I would not expect a payment on the 10th.

Hi Gordon,

I realise this post is very old but I'd love it if you get the chance to just recap on our conversation.

I did ask for a MR but was told I could only score 4 points for prompting because I don't have cognitive or intellectual impairments also I couldn't score points for not leaving the house as I do (even if it is not very often).

I'm just wondering if my case will be looked at again n light of the u turn from the dwp regarding mental health and the descriptors for the planning and following a journey question? Or was this not the kind of this they are changing. I'm confused. I hope you understand my question.
