Morning
I asked for a mandatory reconsideration as my PIP award has ended after my review assessment planned intervention. I completed the new form. I was called yesterday and taken thought the assessment questions . Two of which keep coming back to my mind
How many times do you have to rest during a walk to my local shop apron 10 mins away .? Answer twice but I can't do it again because of the fatigue it would cause me . I have CFS. 2. Are you able to go to unfamiliar places on your own . Answer no. I have severe anxiety Do you know the relevance of these questions ? And the likely outcome. I was awarded enhanced mobility land standard care in 2013, after a medical in march l2015 they reduced my mobility to standard arguing that I drove to the assessment alone which I did not . Now after another assesement they have ended my claim. It's so unfair that they can do this to people thanks for listening

Walking the ten minutes to the shops with two breaks, would mean that you accepted you could walk the best part of 200m even at a very slow pace and likely further if your pace is not overly restricted.

The question about going to an unfamiliar place is a loaded question. The DWP clearly split the reasons for awarding points for the Going Out activity between cognitive / sensory problems and mental health issues such as anxiety. In particular they see going to an unfamiliar place as a navigation issue and do not consider anxiety as a reason why the claimant could not do this. Also, by saying you can go to the local shops, they will take your anxiety as being minor.

Having CFS means that I can walk that far but not repeatedly will this make a difference. If o do it once that's all I can do that day. Regards

Repeatability is an issue that needs to be considered but the issue is likely to be the 10 minutes that you have said that you can walk albeit with stops. Average walking speed is between 72m-90m per minute, even if you walked slowly you are assessing yourself as being able to walk the best part of 200m. It may be that you cannot do this, or that you cannot do it repeatedly, but the initial distance is so long that you would at best only score minimum points.

You need to go back to scratch with this and explain in detail what you can do reliably and on the majority of days, see the PIP Claim guide for definitions of these phrases.

You need to look at the Guide to see the legal definitions for the tests. I am précising the Descriptors but there are basically two sets of two. One set deals with issues of navigation and makes reference to an unfamiliar place, the other two refer to anxiety and similar conditions and does not refer to an unfamiliar place.

So basically the activity does not consider anxiety an issue that would prevent a claimant from going to an unfamiliar place.

Again, you need to look at this from scratch and match your limitations to the Descriptors where applicable.
