Well Mandatory Reconsideration request sent yesterday and received by them today. I used the advice on here and ended up sending in seven pages. Stuck strictly to cross referencing the PIP1,,the ATOS report and our own health professional's reports to demonstrate how our son met the descriptors and briefly touched on why the DM's reasoning was skew-whiff totally screwed up ;) by explaining why an ability to play computer games bears no relation to his inability to prepare and cook food which is in the main down to sensory processing difficulties. After all if that was the case you could always argue that he could legitimately fly a Boeing 747 seeing as he can fly a fighter plane on the playstation :P
Realistically not expecting any change at MR but feel I have set the case to make for a good shot at appeal anyway

Just reading on here that we might get a phone call from the DM regarding the Mandatory Reconsideration. I'm wondering what are they likely to ask? Do they always phone? I wrote verbatim the last paragraph from the example on here stating I wouldn't be withdrawing at any time as a result of any phone call so hoping that might avoid a fishing phone call at least. Not sure after my lengthy submission there is much else to say tbh and I really hate being put on the spot.
We're away next week as well so wondering whether to take paperwork just in case or just avoid the phone calls if they happen. Any thoughts or experience?

Mutty

They don't always ring and they are more far likely to ring for ESA than PIP. Basically they are looking to see whether you can show that you meet the criteria for an award. I would prepare a bullet point list of why you think you meet the Descriptors and keep it by the phone.

Had a letter regarding husband's ESA, (he's in the support group as he is on chemotherapy) The amount altered I assume as a result of the loss of Carer's Allowance when our son lost his PIP award as it was equivalent to Carer's Allowance. The letter on Sunday states that the amount we will receive is going to be reduced again due to a change in the money we have coming in.
Obviously the only change we could surmise would be due to a reinstatement of PIP and subsequently Carer's Allowance but have heard nothing in that regards. Is it possible that ESA would know of this change before we received the results of the MR? Of course it might well be that ESA have cocked up again. Husband too ill at present to sit on the phone and and listen to Vivaldi for 45 minutes to be told they know nothing and will get someone to call him back tbh

I know you want to avoid a call but I can't offer any insight as to what is going on. You can make the call on his behalf as long as he is available to answer the security questions and to authorise the DWP to speak to you.

Phoned to ask whether the request for an MR had been received as had heard nothing not even an acknowledgement that it had been received. Was told that the claim had been returned to ATOS along with the extra information that I had sent in with MR request and that it had all now been returned to DWP and was with a DM.
I'm pleased that it was returned tbh because half expected DM to just reiterate initial decision. Glad also that in MR request I didn't criticise ATOS report instead concentrated on why DM's reasoning in light of reports and ATOS assessment was skewed.
Wasn't able to say when there might be a decision but advised to phone again mid June if we hadn't heard anything.
Is it usual for claims to be returned to ATOS? I had no further medical evidence as I had sent in everything I had I just further explained why our son met the criteria and referred them to the reports I sent in that they seemingly didn't look at.
