Hi Esther,

I can only reiterate Gordon's advice -

You must not present the Fit Note at the same time as you make your claim for JSA as it will mean your claim will be rejected, wait until it is confirmed as being in payment.

Hi

I wonder, does anyone have any information with regards to letters from G.P's? My G.P. has asked to show him any templates or examples I come across in my research (I don't think he's written to the DWP before).

I've looked through the guides, but can't see any references.

Thanks!

I'm afraid we don't have anything on the site as it needs to be reflective of the claimants conditions and the ESA activities that they hoped to score points and there are too many variations.

Any letter of support that they write needs to be directed towards your meeting the ESA Descriptors, so a letter that says you are unfit for work will have very little effect, but one that says that you cannot mobilise more than 50m due to Arthritis in your legs that limits the distance that you can walk and Carpal Tunnel syndrome in your hands that would prevent you using a wheelchair, would be of value.

What you could do is give them a list of the ESA Descriptors, I would remove the points that they score and ask them to comment on the ones that they think you would meet.

Hi, I am on the path to the tribunal, after the DWP turned down my mandatory reconsideration, despite me having made audio transcripts of the WCA interview, which flagged up irrelevant illnesses from 20 years ago, amongst other discrepancies.. anyway, I've got no legal representation and citizen's advice is not great in my area (and I can't switch, they only see you based on where your post code is).
My question was do you have any helpful advice?!

I'm going to send an identical pack I sent to the DWP for the mandatory re-consideration to the Judge before the hearing, so he can see all the detailed information I provided which the DWP chose to overlook.

Thanks
Esther

The appeals section in the ESA area has guides to help you with an appeal and a sample submission to help you create your own.

Remember, the Tribunal panel will only make an award in your favour by your showing that you meet the criteria for one, highlighting issues with the assessment report may help with this, but it will not result in an award on it's own, you need to go through your ESA50 and our Claim guides to make sure that you have shown this to be the case.
