As part of the (c) limited physical tests, I was asked to push the assessor's hands down - not worried as I know my left hand especially is v v weak. I am v unstable on my feet so fell - onto her hands!. She then pronounced that she could "feel my strength!

Does this mean that I may feel the physical element effectively because of gravity ?- I didn't push her hands down with mine, just fell on them.

How on earth do I contradict this?

Hi A,

There is no way of knowing how the PIP Assessor has assessed your limitations until you gain copy of the PA4/Receive the DWP decision.

You can only speculate until then, and I'm afraid speculation does not help.

Just got the medical info form - the one the decision will be be based on. I know many, many people have have had this experience but it sounds as though it's about a totally different person! Challenging it is going to be difficult because just about every line is wrong - e.g. saying I had no problem holding/gripping a bag in both hands when I didn't take one!!!
Should I complain to Atos/DWP about this now, i.e. before the Decision Maker looks at it or wait - on the basis of this don't see how they'd give me anything so terrified.
Can I ask that they check their CCTV - it would show that I didn't have a bag and most definitely didn't walk normally?
So much total lies, how can they do this to us?

Have you had a Decision yet? If not then I would wait for one before you take any further action.

It can be easy to focus on the report but doing so is unlikely to score you extra points if you need them, you will only do this by showing that you meet the criteria for them.

Picking on the issue of the bag, does the assessor say that you had a bag and they witnessed you carrying it or do they say that in their opinion you would have no problem carrying one?

In the case of the former this would be a matter of fact and you should certainly challenge it if you did not have one with on the day. In the case of the latter, they are stating an opinion and it can be difficult to argue against this.

In either case, how does the statement relate to your scoring points? Does the hand strength argue against problems you have documented about holding aids when completing some of the PIP activities? Again, if it does then this might be something to challenge, but if not then is there any value in you raising the issue.

I didn't have a bag with me! Gripping with my L hand is relevant for points since due to L side hemi-paresis (stroke), I have v little feeling in my L hand and foot + have hurt them loads of times as can't feel heat/sharp objects etc. with them. I've detailed all of these + the umpteen injuries on the form but she hadn't read it!

There are so many other absolute untruths on the form which directly contradict what I put on the form and what I told her. The worst, I think, is re epilepsy which she states is well controlled (I wish!) + that I don't need supervision when bathing. Absolutely not true - stated on the form + to her. Many years since I tried this - v v close run thing so never again.
I have had a thought re the epilepsy/bathing point - it does seem almost verbatim re a recent (Tribunal?) decision on epilepsy. Do you think there's some sort of agenda here - heading off any appeal points?

I would be surprised if the assessor was aware of a UTT Decision, but even if they were, a Tribunal panel will make it's own Decision based on the information that they have available.
