Asking Tribunal to contact GP for medical evidence

Hi,

I'm trying to get some new medical evidence for my appeal from my GP. My surgery have recently stopped doing all evidence, but my GP said if they write to her she will do it.

The clerk advised me to email the tribunal and ask them to contact my GP asking for medical evidence and the courts will pay the GP if the judge decides to go ahead and grant the request.

I'm confused what they would be asking my GP for? as one clerk said it would include any medical evidence my GP wishes to include.

Yet I spoke to another clerk and they said it would be JUST the medical records but then at the end of the conversation said if she wants to include anything else.

Do you know what they ask for? As if they just ask for medical reports is it worth doing and are there any implications I should know about going down this route?

if they just ask for medical reports then can I ask my GP to do a covering letter of evidence as the courts will be making a payment?

The panel with have no knowledge of your claim at this time, so all they can reasonably request is a copy of your medical records, usually for the last five years. There are standard charge rates for your GP Practice doing this, your GP can include any additional information that they wish to send with this but I would be surprised if they would be paid for doing so.

I would speak to them about the sort of things that they might include if they did such a letter.

Hi Gordon,

In that case then I'm not confident that she will provide any additional info if she's not getting paid for it but it's worth me asking in case she feels able to do so under the umbrella that the tribunal has asked for my medical records and will be paying for that at least.

Guess I'll find out tomorrow, if she is not willing are there any advantages to getting the medical records sent?

The only thing I can think of is my assessment has failed to highlight the problems I have with extreme fatigue with reference to the descriptors and it appears that my points have been awarded mainly on mental health grounds.
I want to argue this case as the fatigue affects my ability to meet the descriptors (and I reported this at time of assessment) as significantly as the mental health and I feel the former has been largely ignored.
As I have a diagnosis of autoimmune hypothyroidism it has been very difficult getting a diagnosis for CFS but my endocrinologist has pushed to get me seen at the CFS again.
So the point I'm getting to will the medical records show letters from my endocrinologist to GP about CFS ongonig referral attempts? and also my forthcoming appointment for the CFS is just after the appeal, will this future appointment show on the medical records?

I don't see my GP a lot, as there is nothing much more they can so for me, will that be detrimental me as it might flag up in the medical reports?

I'm seen mainly at the hospital,however I've had to cancel some hospital appointments over the years as sometimes I'm not able to attend due to health reasons, will these cancelled appointments still show up on my records? I don't want it to look like I'm not receivng medical care.

Your medical records should include any letter that your Consultants have written to your GP but I would not expect it to include details of future appointments unless they are things that your Consultants have included in their letter.

Lots of claimants are parked by the NHS and don't even see their GP on any regular basis, the panel will know this and take account of it.

It really depends on what you expect to be in your records!

The Tribunal may or may not heed your request, if they do then the advantage is that the records will be included this means that you avoid the panel deciding that they need this information and having to ask for it which will delay your hearing by several months.
