My brother has just had his PIP award come back today and he has been given 0 pts. Brief history he has been on DLA for 18 years suffering mental health illness registered schizophrenia and taking large amounts of medication on a daily basis.

Due to his illness he filled out the PIP forms himself and attend the face to face assessment on his own. (Lamb to the slaughterhouse). On the day he wasn't allowed to refer to some notes I had made for him and he was all most accused of being a liar by the assessor.

I think you will gather the result and how the assessment went. I completely hatchet job. I will be contacting the DWP on his behalf. I would appreciate any advice to assist me in the phone call in the morning.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

When you have a better idea of the issues with your claim, come back to the forum and we will do our best to help.

Hi just had the mandatory reconsider result. On the daily living componet scored 7 points and for the Mobility scored 10 points and been awarded standard rate of mobility. It's very odd that seem to fall under the 1pt threshold for standard living disability part. Should I consider an appeal now or do I run the risk of losing what has been awarded and end up with nothing?

There is a risk to you current award but I can't quantify it for you, we haven't seen anyone lose points for several months on the forum, but it most certainly does happen and it is something that you need to take into account when making your decision to pursue the matter further or not.
