Thank you Gordon, I will get onto that straight away, have spent the last hour making notes of all the other errors one is a complete oxymoron !.
"The reported difficulties are consistent with MSO findings which show reduced hip rotation and flexion, slightly reduced power to the legs and muscle wasting noted on both legs during examination. FME confirms hypermobility of joints and mobility restrictions, risk of falls, easily tired and difficulty maintaining energy levels. In his social history he was unable to complete his studies and voluntary work due to pain. He reports 4 bad days a week and his walking distance when he goes out is 10m or less. It is therefore reasonable to suggest that he would be able to stand and walk with support for more than 20m but less than 50m reliably and repeatedly" Not sure if I should pick up on this yet or wait for decision letter as it was stated in his pip form that any walking causes severe pain and is unable to achieve this activity reliably and repeatedly, we stated that due to shoulder subluxations he is unable to self propel his wheel chair and crutches put a lot of pressure on his shoulders and wrist joints. he just doesn't go out when his pain is that bad. sorry long reply but I think I might be in for a bit of a run with this. many thanks

quick update, I called the pip office and a decision has not yet been made, the file is still with my sons case worker so they have put a note on the computer asking for it not to go to the DM until they have received further info from me listing the errors and backing up with medical evidence (which they already have) but I will highlight the relevant areas for ease.
I think I will have to reiterate the walking repeatedly and reliably in a timely manner somehow.

The decision came through and has gone from DLA HRM HRC indefinitely to standard in both for just two years, we have decided to look at a mandatory reconsideration as the f2f assessment report had 24 errors in it and only one source of evidence was listed on the front page. I have downloaded the guides and called motability who have not yet heard from the DWP. I am wondering if my letter with the f2f corrections and evidence to support actually reached the DM. My sons rate is due to drop in early June, if I go ahead with mandatory reconsideration does the DWP suspend all payments of will they pay the reduced rate until any new decision might be made, does the same apply if we go to tribunal. his car is due to go back to motability in august and he will need to fund another car. thanks as ever for your help

Dealing with the admin first. his new PIP award will remain in payment through out any MR or appeal.

It's possible that your letter did not reach the DM or they chose to ignore it, the MR is a chance for you to re-submit it but remember, dealing wit the issues in the report rarely results in a higher award, this will only happens by you showing that your son meets the criteria for one.

DWP Decision Makers almost always prefer the evidence from the assessor over that from the claimant, a Tribunal will take a much more balanced approach to looking at the information before them.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

Hi Gordon, a quick update, following a telephone request and template letter applying for mandatory reconsideration my son has been moved from standard to enhanced in both elements, he was so relieved not to lose his blue badge because of the walking issues. When I had called them about the MR it would seem that a very important piece of evidence had not been scanned on to the system in time for the DM to see it (it was the adult social care plan which highlighted an eligible need in most areas and funding in place for a PA). With my MR letter I only focused on two elements, walking and being able to cook, they already had the list of 20 plus errors that I had corrected with evidence after the f2f. Also explained with your advice the life long degeneration of the genetic condition. The award is for three years with review after two after which I assume we go through the process again. I am not going to appeal the length of the award because to have it moved up at MR is a rare thing, do I have to notify the dwp that there will be no appeal. One thing I would definitely recommend to other members is apart from requesting the info from the f2f that they check that all evidence has been scanned onto the system as the one piece they had received but not scanned was probably the one that helped to reinforce all the medical evidence.
