If you notified them of the change then the Decision should apply from the date of your letter or a date in relation to your having had your current limitations for three months, whichever is the later. With back payments for any increased award from this date.

This is undoubtedly at the root of the questions that you have had about when the change occurred.

So finally have the letter and decision taken it has taken about 12. Weeks in total I had face 2 face but didn't. Have to go to tribunal my award was taken back to October till April I have been given high rate of care and low rate for mobility which baffles me I am now waiting as I asked them. Qualify for 17 points for care aspect wihich I don't agree with also they are saying because I wouldn't do test for spine and the fact I couldn't do what she wanted and wanting me

As I can't follow an unfamiliar journey on my own and more and more my husband has to take me so I am still going to get them. To look at it again they have given me it till 2019 which is two years which is one really as I had a year left on original award and they are assessing you a year in advance so they will put me through all this again in another twelve months the reason they gave is because my conditions will change on a regular basis which is absolute rubbish
I have long term conditions that are never going to improve arthritis surgeries and hands new shoulder may or may not as surgeons won't give me one as yet but the long term illnesses will not get any better which is my spine had surgery left with chronic pain. my arthritis. osteopenia. And copd which apparently to show that I have it and it affects my daily life I should have whipped out my inhaler to make it look good for me using it even though I didn't nothing but sit in the face to face and didn't do anything strenuous apart. From walk out of atos holding onto partner also I used my inhaler before I went in so just think they are nit picking everything and trying to knock the points down as much as they can to throw you off next time so the length of time is awarded is ridiculous I make no wonder the atos bill is huge if they are sending everyone for these f2f all the time so. I. Am going to wait for the report and then ask them to look at it again ad do mandatory reconsideration even if they do send me to another f2f what I find strange is when I spoke to dwp last week and she realised I. Had now moved into sheltered accommodation on the recommendation of occupational therapist because of my health which they hadn't realised suddenly she said call them straight away if I thought I should get high rate for mobility she said it was already to be posted but if they can't change it now then when I get the letter I should call them straight away so we will see what happens I know they could
Knock my award down. But that's the chance I have to take I can't keep going through this every. Year when I know how hard I have struggled with all this and I have long term disabilitys that are not going to improve any and they still only award me till 2019 will keep you posted

It's your claim and your decision to pursue it further, but I would ask you to think twice about doing so if it is solely in regard to the Daily Living award, the DWP don't do points of "principle".

Thanks for reply Gordon. The main thing for myself is the getting around part and the fact that they say because I couldn't do the things for atos like raising my arm and leg or because I didn't use my inhaler while I was there they cant take that into account when they have all doctors reports and scans they are not qualified to make that statement as they are not medically trained which is supposed to be why you send all the documents to them my consultants are the ones that know about my health issues and they are disregarding there reports so how can they say that and then say that I qualify for care under the same rule but not mobility also another thing I would like to ask is under the points system. FOR cannot prepare a meal which I cannot do as it would be dangerous for me I think that should be the 8 points but they say I only get 4 points as I only need assistance. Not that I can't do the descriptor they are telling me to, So What part of cannot are they using to substitute for 4 points need help to be able to cook as I Cannot even help I cannot chop..peel , lift anything hot or bend to use oven or lift transferring hot items so can you explain what the difference is ? and why they would have changed it to needs assisstance ? and also why would they say that my needs will vary when I have long standing illnesses that are not going to improve any it just seems that they are using the play of the descriptors. then after all this having to run around while not feeling well to fight it and now will have to do it all Over again in twelve months as they are likely to make me apply again next year because they are calling you in up to a year in advance and I guess. This is going to be even
Worse when elections are over it's just not right that they are getting away with this
