Can you imagine if the boot was on the other foot...

Tomorrow will be the first day my payment is due since withdrawing my claim . I am genuinely interested to see what will happen.

I've finally received the medical report form.

I don't recognise it as being my 'session'.

I was claiming ESA because I'm agoraphobic and have generalised anxiety and depression.

Apparently I had a clinical examination which went into great detail regarding how well each of my limbs worked. I was also able to get on to and off of the couch with no problems.

All of this quite remarkable as there was no couch and there was no clinical examination.

Also - we waited for AGES in the waiting room and it turned out that that was part of the test - I had been in tears and on the point of running on more than one occasion but had my husband on one side of me and my father on the other, both of whom had taken time off work to be with me and who both reasoned that I had done so well to get this far and I just needed to get through it so I could go home and forget about it. This translated to "Was able to wait for 30 minutes".

The rest of the report concentrated on the things I can do in the safety of my own home, including answering the door to people I don't know when I had explained about the sign outside the front door advising people who were not expected not to knock.

Reading these forums I am aware that I probably shouldn't be surprised, but I am gobsmacked and furious. This happened last time and we went to tribunal and won and I think that planted the seed that honesty was the best policy. But you're stuffed whichever way you go; be truthful and they will twist that truth to fit their agenda or play along to their tune and they'll just change the hymn sheet.

I am lucky enough to be able to remove myself from the system (where lucky is having a husband working six days a week on just over the minimum wage and being able to manage because we bought our own house and weren't able to have children). But the furious part of me knows that this is exactly what they want and I am giving it to them on a plate.

I finally got a response from DWP today about cancelling my claim and thought I would run it past you because firstly it made me laugh out loud and then I started thinking about it and wondering. Here's what the letter says.

"We have looked at your claim again following a recent change.

We cannot pay you an allowance from 17 May 2017. This is because:

The law says we cannot pay Employment and Support Allowance.

:blink: :huh: :unsure:

Does anybody have any idea which particular law they're talking about? Or is it the "law" that says that the DWP has to have the final word and therefore this is their decision and not mine ? :laugh:

On a serious note, I would like to thank everybody on this forum who works so hard to be of assistance. Even when it's not practical help; sometimes validation of what we are thinking can mean everything. I've noticed over my years in the system that it's become increasingly difficult to make oneself heard which can lead to self doubt or worse; this forum helps so much just by being here.

I suspect the phraseology is simply down to the limitations resulting from the system that they use to create Decision Letters, yours is not a common scenario.

Just to remind you, if you change your mind then you can make a rapid reclaim providing it is within 12 weeks of your claim closing.
