Best approach to postponing an ESA Assessment +

Hello everyone

Just wanting a little advice about postponing an ESA Assessment,

My son who was found Fit For Work last year is now in Assessment Phase again following a new claim on grounds of 'new and worsening condition'. The new ESA50 was sent back to them in March. Yesterday he received an appointment for 24 May in Durham.

On our claim form we specifically stated an afternoon appointment would be required due to the nature of his illness and due to the effects of his medication. They've sent an appointment for 9am! Can I complain about this in any official way?

We also, on the form, requested recording. Our experience last year meant that despite telling them on at least 3 separate occasions and in writing, no equipment was set up when we arrived. We want to avoid this happening again - can anyone advise?

Last year the recording and the report differ (in so far as the practitioner lied). We can't afford to get the official tape transcribed, but we don't want to have the same assessor again. Can we say that? We feel we've a right to say "we don't wish to see the medical practitioner whose lies meant my son eventually ended up with a foodbank voucher", but we don't know (a) whether we can refuse a specific practitioner or (b) if we can, the best way to refuse them

My son will be away on the date of this new assessment which is why to needs to be postponed.The day after he returns he has an MRI scheduled. Clearly a stressful time. I would like to be able to tell them when he will be back and available for the interrogation but I would also like to be able to ask them to avoid the days just after his MRI? Can I do that with any authority, or will they just tell me to naff off?

As my son has cognitive difficulties I do write the letters on his behalf (with his signed authority attached).

Any advice will be warmly received.

He can rearrange the appointment once.

I would leave it until closer to the current appointment and then contact Maximus by phone to move the appointment, make sure that is sorted out while you are on the phone and also include the request to have the assessment recorded.

As to the assessor, if you made a formal complaint about them then it would be reasonable for you to request another person carries out your son's interview. If you did not, then you can still make the request but probably would not have reason for refusing to participate in the assessment if it was the same person.

Quick Q for anyone:

Re complaining about sending 9am appt when form clearly states inability to manage AM appt - has anyone complained formally and what did they say?

I'm thinking of photocopying the page in ESA50 where we state this and then sending it to them asking why they chose to ignore request.
