It normally takes the DWP 5-8 weeks to process a Tribunal result, I would give them a call next week to make sure that they have received the Decision Notice.

Thank you Gordon. Could they go against the Tribunal?

The DWP have the same right of appeal as you do. They cannot take the matter further because they disagree with the Decision, only because they believe that they can show there was an Error of Law in it's making.

It would be unusual for the DWP to do this, but it does happen, if they do then the first action they need to do is to request a Statement of Reasons from the Judge of your hearing, you will be informed if this happens.

If they do appeal, what are my rights in this case?

Appeals to the Upper Tier Tribunal have a number of checkpoints that have to be overcome to progress to the next stage, as an example; even if the DWP decide they want to pursue the matter when they receive the Statement of Reasons, there may be no Error.

You can contest any action by the DWP, in exactly the same way as you did in regard your claim.

Unfortunately we are limited in the advice that we can give as we will have no sight of your papers, so if it happens you should consider get trained face to face advice.

As I said in my original post though it would be unusual for the DWP to pursue the matter further.
