PIP mandatory recconseration rejected was created by Roisin Hudson
Argued my case but as had been observed on a good day and had no other written evidence, just my written arguement, it was rejected. Devistated. MS is a variable condition so short of a having a full relápse what can I do¿

The next stage in the process is to make an appeal.

The PIP Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.

I have MS and depression. The review does not seem to take account of variability of condition and I stated such at Mandatory Reconsideration. Looking for help with MS appeal ground

A tribunal will look at everything from scratch and in a much more even handed way that than the DWP, there will be a doctor on the panel and they will al understand the issues of variability.

Remember it is you ability to complete the PIP activity that is being looked at so you need to explain how your MS affects your ability to do this.

If your condition varies then you need to explain how, they will be looking at how you are on the majority of days, this does not mean that you have to be at your worst for all this time, just unable to complete the activity.

Also you must be able to complete the activity "reliably".
