wolfchile wrote: OK. Thank you. The letter does say MR notice. There is only one copy so will have to send original. There was no mention of why they have turned down my MR just to say they sent it to ATOS and they have sent a supplementary report but don't tell me about it. It just confused me as it says 'You have one month to apply to a MR form the date of this letter. You must do this before you can appeal. It then doesn't tell me anything about appeal process or time limit email etc. Also I don't think I could be anymore detailed than what I have been on my review form and then my MR as I went through it all again in detail. I can't keep up anymore

The PIP Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.

An appeal panel will look at your claim from scratch and they tend to have a more open mind to the evidence in front of them than the DWP who rely heavily on the assessment report.

From you post the MR was not abnormally long, I realise it may have been longer if you had not involved your MP, there were clerical errors in the process, but your main reasons seem to be related to how they looked at the evidence for your MR! Although this is something that you can make a complaint about, at this stage you have nothing but your own opinion that how they handled the MR was defective, so it may be worth you waiting until you have had a result from your appeal before you decide to take the matter further.

I have done my appeal and do not know what else I can say in when i receive the DWP submission as I did it all thooroughly in my MR? I have evidence of things such as having social support that I socred no pnts for and when I raised this in my MR there was no answer to this jsut cut and pasted reply. I ahd provided evidence forma support worker as part of social services care package who came to assessment so thats not just my opnion its fact. I got no points for this despite shoing I need support speciafically for this purpose. I also have a hearing aid and didnt get a point for using an aid. There are things I do not know how to argue or how to show I meet the criteria when I have already done it.

It may be that you do not need to provide any more information than you already have, but it is worth waiting for the DWP submission to the decide.

I got acknowledgement from tribunal service today. How long do DWP get to provide written submission or is there no time limit? Also I have been given extra medication and have a new psychiatrist should I write and tell them this or just wait for DWP submission?
Thanks

The DWP have one month to prepare and send their submission, they will send a copy directly to you.

I would wait until you prepare your own submission to include the new information, but be aware the appeal panel cannot take into account any changes in your conditions that occur after the date of the original Decision.
