Re-Applying for PIP

I hope this may help and you can advise accordingly.
I submitted my PIP Forms back in Aug 2014. I was awarded 2 points at the assessment.
I appealed, they rejected it and so it went on. I eventually got a hearing at a tribunal at the end of Oct 2015. The whol process had taken just short of 15 months. I was interviewed at court by the judge, a GP and a disability specialist. I was given a 3 year award. I was awarded 12 points for mobility and 14 points for daily living. I received nearly 16 months back pay in Nov 15. Like many people on here, I went through hell and back including complaint letters to ATOS about their treatment of me and very kindly, the judge apologised for everything I had gone through. It is now 18 months later and I have received a one page letter from the DWP inviting me to claim again if I so wish. I cannot believe I have to go through all this again. I never wanted the money in one lump sum, just the 3 years of peace of mind. I have had only 18 months, now the nightmare returns. The DWP told me yesterday I do not qualify for an AR1 form and have to fill out a PIP 2 form again because the initial award was made after I appealed and not directly from the DWP. I have received a text from them this morning telling me the papers are in the post. I feel like sending in exactly what I sent them last time including the courts findings and how they allocated me the points and an updated doctors letter because absolutely nothing has changed with me, including medication. Then I just appeal it until I can get a court hearing and hope the judge awards in my favour. Have you any experience in other members who have gone through this and how I should approach it? I would be grateful for any help.

I'm afraid your case is not particularly unusual.

The three year award ran from August 2014 so expires this year.

Given that your previous form did not result in an award I would be cautious of taking the content verbatim in to the new form as you are setting yourself up to fail again. There have also been changes to the Managing Therapy and Going Out activities

I would strongly recommend that you at least consider revising your answers based on the advice in the current PIP Claim guide.

Dear Gordon
Thank you for your advice.
I wasn't being flippant, just that an AR1 form appears to be so much user friendlier. However, I appreciate I will have to submit another PIP 2 form and go through another medical. You cannot help but feel it is all a waste of time as they will either award 2 points or 0 points like last time. I do not understand why the Tribunals do not award 3 years + time it took to appeal. Some people may be fortunate to submit their claim and then get an award for 3 years. Others may submit paperwork then have to fight for 18 months, get awarded a 3 year award in a tribunal then 15 months later they have to start the whole cycle again. It is just a very stressful outcome for many people. I assume it is done this way to deter claimants from re-applying.

Given the choice I would prefer to complete a PIP, the AR1 requires those assessing you to refer to your previous assessment information and I'm not convinced this happens in all cases.

A new form gives you a chance to bridge the gap between what you write last time and what was accepted by the Tribunal panel. I doubt very much that you really want to have to go to appeal again :)

I'm afraid it was within the Tribunals authority to increase the length of the award if they had wished to do so.

Dear Gordon
Thank you for your advice so far. I managed to secure a two week extension as I knew I would struggle to get it done in time. I only have the last question, Q14 to complete. I have been using your guide and it has been a great help to me. Due to past experiences with the DWP I can but hold my breath. However, one question I do have that is relevant, Should I lose the mobility aspect to my claim, will they take the car off me when my 3 years is up (Aug 17) or am I allowed to keep it until my appeals have been heard up to and including a first tier tribunal. I have tried to find this info but only seem to find this on Benefits and Work. Following statement made be Penny Mordaunt "Allow claimants to keep their Motability vehicle whilst appealing a decision that they do not qualify for the enhanced rate of the mobility component of PIP." This was dated 7 Dec 16. Have you heard anything else since?
