Thank you for the link. I have seen this before but does not answer my question. It referes to people transferring from DLA to PIP. I am currently on PIP and was granted a 3 year award from the courts. I currently receive enhanced daily living and enhanced mobility. Last December the Minister for disabled people inferred those on DLA who were transferring to PIP and got turned down for enhanced mobility who then went on to appeal would be allowed to keep their car until a final decision was made. My point is this has been aimed at DLA participants and not PIP participants. Considering the appeal and tribunal process can take around a year then the Minister for the disabled has inferred you can keep your car for that period of time which could realistically be around a year. The link you gave me infers a claimant can only possibly keep their car for 8 weeks. However, as I have stated appeals and getting a first tier tribunal date can take over a year. So confusing. I know it sounds jumbled but so am I. I know it is late but due to pain I stay awake until I fall asleep. Thanking you in advance.

My bad I didn't check the content properly.

I'm afraid for PIP claimants Motability will require the car is returned immediately, in practical terms this will usually be within three weeks of an adverse Decision.

Dear Gordon

Thank you for your help so far. I have another question though.
I had a face to face interview with a health professional from ATOS when I first claimed PIP 3 years ago. It really was terrible, she clearly had not read my file, letters, note nothing. When I tried to point information out to her she told me she will look at any paperwork later. The whole process was terrible and she blatantly lied on her report about everything. I got a copy of her report before a decision was made on my case. However, irrespective of the risk, I made a complaint to ATOS about her, her methods and the way she treated me. I later received a letter saying I had only scored 2 points etc etc. My question to you is, should I send copies of my complaint about her and ATOS's response when I submit my PIP 2 so they know I have had problems before, or should I just treat this as a new submission. I only say this because of the terrible time I had before. My GP has me on Diazepam just so I can get through this part. Thank you.

I'm afraid I don't see any point in doing this, the Assessment Provider will undoubtedly take the view that this is a new process, based on your conditions and limitations as they are now, so the complaint has no relevance to the here and now.
