Hi
I was wondering if anyone can help me, I suffer from mental health problems, Depression and anxiety, Borderline Personality Disorder, and waiting to be seen to be assessed for Biplor. During this time I have managed to function and hold down jobs through my adult life (as been on and off medication) but over the last couple of years I have been having severe bouts of depression and anxiety where its now effecting my work and private life. At the moment I have been signed off work and this time feeling its gong to be long term. I have been off work now for 3 months and my SSP is due to run out. I dont think I will be going back anytime soon. I have applied for pip and awaiting F2F.

But my questions is CAN I RESIGN FROM MY WORK PLACE ON THE GROUNDS OF MY MENTAL HEALTH AND APPLY FOR ESA. my problems vary from on day to the next and going out and doing things I have been advoiding of late.

any help would be greatful

Welcome to the forum, you might want to have a look at the following FAQ which explain where everything is

Please do not resign without getting face to face advice you would be given up your rights as an employee when you do not need to.

You can make a claim for ESA while you remain employed, to start as soon as you SSP runs out, so if that is about to end you can make a claim for ESA tomorrow.

You will need a Fit Note to send to the DWP, so speak to your GP about this.

Hi Gordon

thank you for your reply I have read the guides etc and am in limbo as I cant resign from work till work terminates my contract.

I got a letter from work today, saying they are coming to my home for a welfare check and also dicuss about going back to work. but i am no way ready.

I will have to tell them this and ask them to let my go (end contract).

When should you think I should Claim ESA. As I think I would have to go through my months notice period 14th of june.

Please do not resign or offer to resign, you have rights if your employment is terminated by your employer, you have none if you resign!!!

Also, you do not need to resign to claim ESA, your claim can start from the day after your SSP ends, you can even make the claim in advance so it is ready to go as soon as the SSP ends.
