I would not expect her review to be looked at again before May 2019, it's 12 months not 18, you should keep an eye on this as it could be later. A Tribunal Decision is one of the circumstances where the DWP will not actually reassess the claimant and will require a re-claim, your sister should be notified of this no later than 13 weeks before her award ends.

Hello Gordon: My sis receives ESA (IR) (Support Gp) as well as PIP enhanced/enhanced. Do you, please, have a view on whether, and if so, to what extent, PIP determinations affect ESA ones (and vice-versa)? Sis was very recently awarded PIP enhanced/enhanced following appeal. Is DWP likely - which seems reasonable and sensible - to accept that there is no need to review ESA (assuming her income hasn't changed - it hasn't)?

I know they're different 'medicals', but of course overlap. It would seem untenable to me on the one hand to accept that X has 'enhanced' functional impairment (PIP) but nonetheless might be too 'functional' for the Support Gp.

I ask because I've just, as her agent, been sent an ESA review form (prior to the PIP appeal outcome, before which she was getting enhanced daily care). It seems to me wasteful of DWP's resources and unnecessarily anxiety-inducing for her to be reassessed for the SG when it should be obvious she is no better than when she was awarded it.

Thanks very much,

Marcus (sorry, I'm sure you've been asked this before...)

I'm afraid a PIP assessment cannot substitute for an ESA Assessment , although there are areas of overlap between the two benefits there are also many areas that are unique to each.

If you have been sent a form to reassess her ESA claim then you must complete and return it or you risk her claim being closed, the same applies to any assessment that she might be asked to attend.

Hello Gordon: As sis is in the Support Group and rec's enhanced/enhanced PIP due to psychological disability I think she would qualify for this discount (she's a single occupant so rec's the standard 25% discount currently in her private-rented property). But as she already rec's full CT discount via benefits, so pays nothing, is there any advantage to my applying for the impairment discount, please? Her GP will charge for the certificate. She may in future need a bathroom adaptation to replace a shower-over-bath with a cubicle as she has dizzy eps, so I s'pose it could help for that...

Thanks very much!

I'm sorry but we don't advise on Council Tax, try putting her information into one of the online benefit calculators
