Decision letter just arrived was created by lollipop
Hello Gordon, I would appreciate some advice on the way forward. I have just received my decision letter today and all points were for the use of aids. I have gone from lower rate care / enhanced mobility DLA to PIP standard rate for care and enhanced rate for mobility. In all, I am happy about this. I have been given a two year award as I have been referred back to the surgeon hoping to have surgery for my knee, which he has ruled out now. The DWP's decision is not correct as lots of important point scoring items were ignored, I have a strong argument to increase points, even on mobility. But, at this stage, 12 moving around is good enough . The care side could go well over 12 points to the enhanced rate.

As I will have to be reassessed again in twelve months and go through it all over again, will it be a renewal form - or the face to face and start a new claim.

The point is, asking for a reconsideration now causing more stress I am not sure about. If I accept this decision, next year can I submit everything again and then argue when I am stronger and hopefully things will change within the pip experience for the better and wont be a stressful. it just does not seem right when the paper work is not accurate, I hope they don't say next year, "why did you accept our decision last year" thank you.

Forgive me but I am a little confused by your post, in one sentence you appear to say that you are happy with the award and then go on to ask for advice in challenging it.

Looking at the Mobility first, if you have an Enhanced award then there is absolutely no value in challenging it for a few more points.

As to the Daily Living, you say you should have received sufficient points for an Enhanced award, but didn't, do you understand why the DWP have not awarded the extra points?

As to challenging the Decision.

Realistically you may have to go to appeal as revision rates at MR are quite low. It could be six months before a hearing is held and there is every chance that even if you received an increased award it could still for the same period.

A reassessment is likely to be done using an AR1 form, but I cannot guarantee that. Although this form talks primarily about change that does not mean that you cannot re-present your problems as they are affecting you at the time.
