HELP TODAY - JobCentre Compliance meeting ESA

I really need some help today,- I've been trying to get onto the site via my iPhone since Friday and kept getting an error message saying site was down. I'm in such a state I hadn't thought to try and log in another way.

In summary, I am on ESA WRAG as I am unable to work and have been off ill for more than 2 years. I have 3 health conditions - 2 permanent and don't want to give specifics for fear of being identified. To begin with I got contribution based ESA as I was still getting paid for being off sick through work. This was the case for a while, then a few months before my ESA Cont Based was coming to an end, I got a letter from work saying sick pay had been exhausted. I was given options to return immediately (which I couldn't do due to health), resign or apply for their Disability Scheme. I applied for Disability Scheme which meant giving up my actual role at work and going onto half pay with continuous health assessments.
As soon as I signed the paperwork to relinquish my role, I phoned the DWP to tell them about the change to work income and they asked me to send a hard copy of the contractual changes in writing which I did. 10 days later, I got a new Award Notice saying I was moving from CB ESA to IR ESA due to a change in money coming in. That was about a year ago and up until Apr '17 everything was ok.

Last month I had to go for a reassessment for PIP which put me into immediate flare up/panic before and for 10 days afterwards. During this time, I hadn't realised that I hadn't received an ESA payment. Once I realised I assumed it was due to the bank holiday so I thought I'd get a double payment next time. A month went by and no payment. I was so stressed about money and this was making my health deteriorate. I eventually got through to DWP to ask why I hadn't had a payment and their tone completely changed. I was given a name & phone number to phone for more info. I didn't phone right away as I was unwell myself and had my daughter unwell to deal with at the same time. A few days later I received a letter from Compliance at JC+ asking me to attend a meeting as there were 'concerns' about my entitlement to benefit. I realised letter was from the same name as DWP gave me so I didn't bother to make the call, thinking it had already been sorted. Following week, I get 2 letters from DWP - 1 to say ESA was stopping as of Apr (1 month before it was written) and second saying that mortgage interest payments had also stopped retrospectively due to 'a change in circumstances'. On Sunday I get an email from Council Tax saying that this reduction has stopped too. I called Compliance at JC+ this Monday to ask what was happening and got very brief info to say it has been identified I'd been claiming benefit on top of receiving income from my employer and hadn't told them. I've to go to the meeting tomorrow with a whole host of paperwork and I'm absolutely panicking. I've not eaten or slept in days and lost a stone. This is having a detrimental affect on my already poor health.

Over and above this, my employer deducts money from the disability income every month so I can claim it back through ESA. Plus, in December 2016, I had an alarming letter from the tax office saying I was due over £1200 cos of unpaid tax. I wasn't sure why as my employer does tax via payroll. I phoned HMRC and was told that they had the IR ESA as my only taxable income so I'm paying back £200+ per month to get shot of it asap. At the time I took it as read as I didn't know any better.

Am I in trouble, and what will the consequences be? If my employer gets wind of this I will likely be dismissed for gross misconduct due to the nature of the business I work in.

Please help in anyway what I need to do or ask tomorrow. I'm so worried about this and money, plus if there's an error does it mean I've got to pay it all back? I've no idea how I can do this on a lower income.

The only positive is that while this has been going on, I've had PIP results and remain on low rate for care & disability, plus it's been extended for 2.5 years so at least I don't have to worry about that for the time being. I didn't get any points though for something that I think I should have. I know I can try to appeal but I think that doing so on top of the ESA issue just now will finish me.

Forgive me but I am going to recommend that you get face to face advice as quickly as you can, it's not that I don't want to help, but you need an advisor who can get sight of the letters you have received recently and in the past and we can't do that on the forum.

Do an internet search for "welfare advice" with your postcode, town or county.

From you post the DWP have not been deducting the payments from your employer from your ESA and the issue revolves around whether you notified them of this income or not.

If this was the only reason that you joined B&W, then please contact the office and ask for a refund.

Thanks Gordon. I've only picked up your message and mtg is early tomorrow so there's no chance I can see anyone else beforehand. I'll have to do this after the meeting.

No, I joined the forum for help with the forms originally so I'm not looking for a refund.
