My ESA Tribunal was adjourned in early March this year, as the panel wanted to view medical records. After I took advice on this from my GP and others, I wrote to the Tribunal service to notify that I was withdrawing my consent for access to these records - giving three very sound reasons why.

I had initially been informed that the next Tribunal would take place before the end of April. I forwarded written notice of my withdrawal of consent in mid-April. I have confirmation that this was received. So far I have heard nothing from the Tribunal service as to when the next appeal hearing will take place.

I have tried to contact my welfare rights representative for advice. No response.

I have two main questions:
- Should I contact the Tribunal service to find out what is happening - or is it best to leave well alone?
- If i eventually lose my ESA appeal, can I make a new claim 6 months from the date of that appeal Tribunal (whenever it might be), or can it be made 6 months after the March Tribunal (i.e. in September).

I'd appreciate any advice people might be able to offer.

Contacting the TS is up to you, they may be able to tell you wait times for a new hearing.

You can make a new claim for ESA immediately, however, it will only be accepted if you can show a documented deterioration in your current conditions or a new conditions that would reasonably result in an award. Even if the claim is accepted, they may not pay you on it until you have attended an assessment.
