I would keep it simple and perhaps say that you thought that the information you included with your form was simple to understand but after asking relatives and friends to look at the statements you wrote you now realise that they could be interpreted differently from what you had intended.

Then provide a simpler explanation of how you are affected with perhaps some worked examples.

Hi

My MR decison came back unchanged so I'm trying to sort out my appeal now. It's such an overwhelming task but your guides are really useful.

I was wondering at this late stage whether a statement from a family member would help my cause? My wife and I are separated but I know she would write a statement if I asked. She knows me better than anyone. If so is there any guidance on that?

The PIP Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.

A statement from a family member may be helpful. They need to identify themselves on their letter, explain how they know you and how often they see you, detail the problems they see you having and then lastly attest that the information is correct to the best of their ability and sign it.

Hi Gordon,

I've been giving your advice a lot of thought and have gone back over the advice given in the guides and I think I need some clarification. I have a few days left now to send the appeal and have my written submission in a very rough format. The guides say that the written submission should be sent in within the 28 days and yet you state that that can be sent in later after the appeal has been submitted.

If I hold up the process then am I not holding up the time frame for DWP to complete their report? It could turn into a game of paperwork tennis.

Although you can supply detailed reasons with your request for an appeal you do not have to and I would recommend that you don't.

So you first need to request an appeal with an SSCS1 form, whilst this does require your reasons for appeal, these do not have to be detailed.

Once your appeal is accepted the TS will send the request to the DWP who will create their own submission and send you a copy.

Technically, you have one month from the date of the letter accompanying the DWP submission to create and submit your own detailed submission. If you have requested a Paper appeal then you need to stick to this deadline, however, if you have requested an Oral appeal, then the TS will accept information for your hearing up to seven days before the hearing.

Ok, that makes sense. I didn't know about the further 28 days from the DWP submission.

So, the idea is to be as general as possible in the first instance? I suppose if it's too general the TS will send it back anyway.

Without wanting to sound too cynical, is this so as not to show your hand too soon as a 'defendant'?
