MR Decision Received was created by mobbba
Hi Gordon...I decided to ring DWP yesterday, to see if they had received my MR. She said yes, there is a decision do you want to hear it?

Apparently my MR was redirected back to the assessor and the decision came back the same ZERO points.

Am I right in thinking that a different DM is supposed to look at my MR and make the revised decision?

On my MR I gave an explanation of how things affected me on a daily basis on all the descriptors backed up by medical evidence.

I never focused on the lies told.

I know I will now have to appeal. But at what cost is this to me. My mental health has suffered immensely. I am an emotional wreck. I have Cervical Spinal Stenosis of 3 discs I can hardly lift my head up, the pain is so bad across my shoulders and neck. It is made worse by the stress of being taught and tense.

I felt today like, what's the point of going on. I struggle every single day, like most people on this site. I have looked at the section on appeal and I just don't think I can do it !!

All the health issues and barriers I face every day I simply cannot understand how this assessor could have told the lies, putting me through an appeal now, just to get my benefit re-instated.

Sorry........more tears. I just want it all to stop. Its been 6 months now.

DWP are also not helping. They sent my MR decision out on 4th June, not received it yet. I asked for a copy of the assessment report 4 weeks ago and still not received it. Had to request again yesterday, so this will take two weeks and I will have no time to make my appeal case based on the assessment report.

Its a mess Gordon

Yes a different DM should have reviewed your file but it would have been referred back to the same assessor.

You will need the MR Notice to lodge an appeal, but it's late delivery would be Good Cause for a Late appeal if one was required.

The PIP Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, this will include a copy of the assessment report. Whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.

If you have further questions then please reply to this post and we will do our best to help.
