Hi,
I have been on ESA in the support group since 2012.I recently had to reapply for ESA and with notes from my doctor I eventually managed to get a home visit.However a doctor turned up totally unannounced to my house and I was unable to get to the door, as I am disabled with M.E.
I contacted the DWP but they insisted they had sent me an appointment letter but I didn't receive it.It was referred to a decision maker and now ALL of my ESA including my partner's who is also sick has been completely stopped.Please help

I'm sorry to hear that you are in this situation.

You need to show that you did not receive notification of the assessment, I'm afraid your word that you did not will not be sufficient! Also, you need to be prepared to take this to appeal.

You also have the option of making a new claim for ESA but you will not be paid until you attend an assessment.

You will have to request a Mandatory Reconsideration of the Decision. This needs to be in writing to the DWP office that was dealing with your claim. There's a template letter you can use in the ESA section.

In the interim you need to make a Subject Access Request to Maximus for the following;

1. A copy of the missing invitation letter.
2. A copy of your computer record showing the address that they have on file for you.
3. Proof that the letter was posted by Maximus and when.

You can write a letter to Maximus headed "Subject Access Request", you can find the address from the following.

www.chdauk.co.uk/contact-us

You should also contact your local Royal Mail office to see if there have been problems with mail deliveries in your area.

Do you have examples of mail going missing before?

Is your address one that could easily be confused with someone else's?

Can you check with your neighbours whether they have had the letter?
