Hi can anyone help with my query. I was in receipt of esa ib and claim began in 2014. I was also awarded DLA and PIP and get enhanced for care and mobility. Because i lived by myself at the time i claimed the carers allowance as i was entitled to do so and i believe i received such - i think my payment at the time was about £360 a fortnight from dwp. I stopped claiming carers allowance 2015 - the end of the tax year as i moved in with my son who then claimed the carers allowance. I cancelled my claim for esa this april 2017 as i married and did not think i would be entitled to esa ib anymore as my husband works. Anyways after a conversation with a friend they told me that i should be able to get esa cb as i will have had my ni contribution paid while in receipt of such benifits. i have checked my ni status and i have paid full ni contributions since 2014 but i understand there is critiera to meet. Can i get esa cb on my benefit types as above please as i really dont undetstand it - sorry. I did work full time upto 2007 and paid ni but havent been able to work since. Thank you for any help and advice.

Hi update I just phoned hrmc and they told me Dwp have only paid me class 3 national insurance contributions I am so confused as everything I have read says I would get class 1 as I was on esa ib and they also told me I have no carers contribution so what did I get please-severe disability premium????

There are several issues.

First, you cannot claim Carers Allowance against your own DLA or PIP, based on your post it seems more likely that you were receiving the Severe Disability Premium, this pays roughly the same as CA.

This is important, were you receiving CA against someone else's DLA or PIP or were you receiving the SD Premium?

ESA and other benefits do not pay NI Contributions, only NI Credits, so if you have not worked for some time due to illness you will not be able to make a new claim for ESA(CB) as you will not be able to meet the Contribution Conditions.

However, there is an exception to this test if you had indeed been in receipt of Carers Allowance.

Thank you Gordon I must have had the sdp which is not good news but nothing can be done I thought I had claimed carers for myself. Don't understand why they processed a claim for esa cb though that's daft and a waste of time was on phone to them for two hours lol

Sorry to be a pain but if I was able to earn a living from home. I used to sell books online. In the future would class 2 self employed contributions qualify me for esa cb if so how many years and which class 2 thankyou

They would but I believe that you can only purchase Class 2 NI Contributions if you earn over the limit.

As to when you could claim. there are two Contribution Conditions, for the First you need a minimum of 26 weeks of NI Contributions in a usable Tax year, so any earned now (2017-18) will not be usable until 2019 and by then you will have problems meeting the second Condition, which is a minimum of 50 weeks NI Contributions or Credits in each of the two complete Tax Years preceding the year of claim. So in 2019 you may have a hole due to your closing your ESA claim.

When did you close your ESA claim? Was it less than 12 weeks ago? You did not need to do this, your ESA payments would have stopped but you would have continued to receive NI Credits.
