I am transferring from an indefinite award at the higher rate for care and mobility to PIP. I notice on the initial telephone call (pip1) to make my PIP claim they asked me if they could use previous evidence that supported my DLA claim. On the one hand this seems like a good idea as my evidence for my DLA claim was strong and resulted in the highest award. On the other hand PIP is a new benefit with different descriptors and questions. I'm concerned even though my DLA evidence was strong it may damage my PIP claim. Should I say they can look at evidence from my previous DLA claim or not?

There are two issues you need to consider.

First, how old is the DLA information and is it still relevant to your conditions as they are now? If it is new and still relevant then it is something to consider including, if old and out of date, then perhaps not. If it falls in the middle then look at what other information you have available to support it.

The second issue is relevance to PIP, the assessment criteria for DLA are different from PIP, DLA looks at the amount of care the claimant needs and PIP looks at the severity of their problems! So does the DLA evidence address the PIP activities, if it doesn't the you may dilute your claim by including evidence that is not relevant.

Well the evidence is old it's from 7 years ago. Also my EMP medical report by ATOS from memory was mediocre even though I got the award. The HP started to answer the questions for me! Also the GPFR (The gp report was awful as he virtually left it blank as he didn't know me ie not my usual gp filled it in). The evidence I gathered myself from my consultants was strong.
However as soon as I got the DLA to PIP letter asking me to call to claim I started gathering medical evidence relevant to the PIP descriptors which covers all the bases. So far I have 4 pieces of evidence to go with my claim form from my gp, consultant, and 2 specialists. Is that enough?

Oh and to clarify it isn't me thinking of sending my old DLA evidence in with my new PIP2 form - it's me giving the DWP permission to look at the evidence they have on file from my previous DLA claim which they ask in the initial telephone call.

Based on your post, perhaps it's not a good idea to let them use your previous DLA information.

As to the evidence you have collected specifically for PIP, do you think it is sufficient? I have no view of the information so it's a decision that only you can make.

It's interesting that they should ask you if they could use the information from your DLA claim. During the telephone call to first claim PIP, I was told that they had no access to previous evidence supplied by health professionals in support of my DLA claim.
