Yesterday i heard that my manadory reconsideration was unsuccessful i was devastated. Everything i have i always have to fight for it. Here we are again having to fight for something. My husband works 20hrs per week looks after me rest of time. We are now left struggling financially. The HCPP was rude when i had assessment and didnt even look up. I was squirming around in my chair for 25mins or so in pain as i jave a chronic pain disorder. No 2 days are the same. I take opiates for pain and now got pain patch which is alternative to methadone. Im constantly tired sleep when i can and only had 9 points. He said cos i use a smart phone and talk to people at the drs surgery i am fit for work. I have tried going to work twice but it was making me ill and it was only 4hrs a week.
Not sure if i will fight. One very angry but extremely upset person

The success rate at appeal is far higher than it is at MR so a failure at that stage doesn't mean you cannot receive an award, but you will need to show that you meet the criteria for one. ESA has very specific criteria and you must show that you meet the ESA Descriptor to score higher.

The ESA Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.
