I have recently transferred from DLA to PIP and have requested a mandatory reconsideration in respect of the mobility element as the assessor contradicted herself by saying that I couldn't walk 10m, but than ticked the box that I could work 20-50 metres.

However, that isn't this reason for my starting this topic. Today, I received a letter from a lady at the other side of the country to me advising me that whilst dealing with her PIP claim the DWP has sent her my assessment which had been scanned onto her file. She has copies of my assessment including details of my diagnoses, medications I take, copies of consultant letters, GP reports and physiotherapy reports. She also has my date of birth, National Insurance number address and telephone number. She has sent me some photo copies of some of the pages as proof.

She advises that she needs to keep my information at this time, as she going to tribunal, as the DWP has made a decision on her assessment using my information, which she needs to the tribunal, and then she will return my assesment information to me.

I am absolutely flabberghasted and not sure how to proceed in respect of making a complaint to the DWP as this is a clear breach of data protection as I want this investigating at a level beyond the telephone call centre.

Advice welcome.

Make complaint to the Information Commissioners office

and a formal complaint to the DWP.

Complaining to the DWP

Make sure you tell them of the complaint to the ICO.

On thinking, as my assessment information was sent to this person by the Tribunal service, I will have to also make a complaint againt them.

The DWP will have sent the information directly to the claimant, the TS receive a copy and then add to it.

So it's the DWP not the TS although you could argue that the TS would be culpable for any further copies that are distributed.

I would contact the TS and inform them of what has happened and warn them that you may need to make a complaint about them to the ICO if the report is further distributed. It's likely that they people who would make the copies would not have checked the content.
