Hi

I made my phonecall to transfer from DLA to PIP on 18th Jan. There were various extensions needed as I was so ill and had little help to fill in the forms. I submitted PIP2 on March 22nd. I had my medical on 15th June and was awarded PIP on 28th June.

My quesion is, do they backdate the payment? The letter I received told me I've been awarded the higher rate for both living (£83.10) and mobility (£58.00) 'from 26th July'. 'We will pay £524.09 into you bank account on 21 Aug. This is the money we owe you from 26th July to 20th Aug. We will then pay your benefit into your usual account every four week sin arrears. Why do they get to assess me, take weeks to process it before calling me for face to face and then only pay me the new amount from one full month AFTER the decision???

Please let me know if this is right?

I'm afraid as you were being moved from DLA there is backdating of the PIP as the legislation does not allow it, it could have, but it was not drafted in a way that allowed it.

OK, not backdating it is one thing. But awarding it on 28th June and saying it's for the period 26th July 2017 - 14th June 2020, hence buying themselves another month of paying me at the very reduced rate I was receiving on DLA? And on top of that not paying it into the account until Aug 21st!?? How can they get away with that?

OK, so the PIP Transfer legislation requires the DLA to remain in payment for four weeks after the Decision is made. The your new PIP award is paid four weekly in arrears.

You need to understand, the Government did these things because PIP was designed from the outset to be a significantly more difficult benefit to award than DLA, the issues you have posted about are actually advantageous to claimants who's award is reduced or removed. As I said previously, they could have taken with all claimants fairly, but they chose not to.

Yes, I do see your point there, Gordon. And in all fairness I'm happy to go without four weeks money if it means that those who may have their DLA reduced or removed at least have it up until that point. Thanks for clarifying.

You won't lose any money in the transfer, fo any particular day you will either be paid DLA or you will receive your new PIP award.
