PIP Result bad news was created by Nasus76
So the brown envelope giving me my result of the transfer from indefinite DLA (mobility) to PIP has arrived and the news isn't good. I have been awarded standard rate Mobility so will now lose my car. So now I start the long appeal process. Any tips gratefully received.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

Thank you I'll look into this tomorrow. There are some outright lies in the "my decision" part of the award letter so I will definitely be challenging those. I hope to get some evidence from my workplace and will also need to see my doctor as DWP are claiming that I can't have anxiety as I haven't had help for it and don't take any medication. In fact I did see my GP about it (this was stated in my PIP application) but I can't take any medication due to the nature of my disability. I fear a long struggle ahead!

After discussing the issue with my parents over the weekend I am thinking about not challenging my award this time as I don't think I will have time to gather the additional evidence I will require in time to put in for mandatory reconsideration (I'll need letters from my workplace and from my GP/Specialist for example). Instead I can gather this information for when I am reassessed in 2019. However I am wondering if by not challenging now, if this will affect future claims? The thought of having to go to Tribunal really frightens me and the thought I'd have to do so every 2-3 years is really unappealing. Any advice would be appreciated.

Revision rates at MR are very low so if you do not feel that you can face a Tribunal then this may be the best solution for you. You can change your mind at any time within the 13 months following the Decision date, but once you go outside of the first month, you will need to provide reasons why your request is late and the DWP can refuse to accept these.

Thank you Gordon. I have requested a copy of the assessor's report however and am gathering some further evidence should I decide to go ahead with the appeal.
