Hi,

Sorry this is my first time here. I just received my decision letter stating that I am no longer awarded after being awarded 3 years in January 2015 due to review in 2017. I was re-assessed and it came back the dreaded news but like many others were filled with inaccuracies. I am asking for a mandatory reconsideration but need advice. The gentleman on the phone said for me to send a cover letter with any supporting evidence a long with my reasons why I disagree with their decision to the address on the letter within 28 days. I suffered an injury in 2013 which rendered my inability to use my left hand, glass had severed the tendons/nerves after going to the hospital they took an x-ray and said that everything was ok, 2 1/2 months later and several appointments to nurses/doctors at both the hospital/GP I was finally referred to a specialist but the wounds had healed but still had no function in my thumb and lack of feeling across the left side of my palm from the tip of my thumb. I had to undergo corrective surgery which had no guarantees as the length of time between the accident and surgery was too long to provide any definite results. 6 months in pain and going from completely independent to relying on someone to look after me took its toll. Shortly after my sister died on Christmas eve and that really added to the heap and sent me down a spiral of why is life worth living anymore if it can give you this much trouble. I've been on antidepressants since along with battling my type 2 diabetes it has not been easy. I take 10 pills a day and an injection once a week and this has an affect on me. I'm still unable to grip things, I cannot focus and my life has just been taken away. Thank you for reading and for any advice I am given.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

Called DWP first thing this morning and requested the assessors report. Lady on the phone said up to 10 days. In the mean time I've requested a support letter from my doctor along with a summary of all conditions, ailments and any treatment I'm receiving. Will keep you posted. Many thanks again.

Just an update, while gathering evidence for my pip claim my esa reassessment came through but had to be cancelled because the assessment centre didn't have my case files and I await a new appointment for that.

I received ankther letter from the specialist at the hospital confirming the same information from the doctors letter which hopefully with strengthen my case. I have sent these to esa handling centre with my national insurance/name/address on the back and hope that they make the case files before the assessment as previously I only had the fit note to go by.

I am awaiting until the 1st August for the assessors report and if I don't receive it by then I will send all gathered evidence along with my cover letter regarding the MR to pips and see how it goes from there. This has caused a lot of stress and just can't wait for it to be sorted.

A further update on the current situation. Received my assessors report after 5 working days which I was quite impressed about, the report however not so much, full of inaccuracies.

I used your guides to assist me with the letter I sent along with my carers support letter and a general day to day report as she is a live in carer. I sent everything, all doctors letters regarding my conditions and results that show their claims are inaccurate.

It has been 7 days since sending first class recorded. Wish me luck, and thanks for reading.
