Unless the complaint has been upheld then I think the panel will have little interest in it, the same for the MR, they are really only interested in whether you meet the criteria for an award.

I was wondering if I should mention to the tribunal - that the ATOS assessor in her report said in the section about evidence used for basing her report , that she used a signed and dated letter from my GP, however, I was at my GP last night and he said that no such information had been requested .So if ATOS had said that they must be referring to an old letter . The DWP say they use the best information they have to make their decision but this has came up at this late stage and im wondering if I should do anything etc.

If there is a GP letter, new or old then it should be in the DWP's submission!

Although dismantling the DWP's case can be important it will not result in an award, the Tribunal can only rule in your favour by your showing that you meet the criteria.

Thanks Gordon, after I posted I remembered your previous post, it was my visit to my GP got me a bit flustered , panicked me a bit like feeling it is like some sort of criminal case etc. I think ive got everything sorted in my head now.

Not posted for a while but yesterday I phoned DIAL who were going to come along to my tribunal hearing to help me to ask if they knew how long pip appeals were taking and they said the longest they had heard of was 7 months which is right on the time for mine at the moment althogh iive not heard anything yet. The lady said that the person who would have helped has some problems and cannot be sure what they are doing each day so this has got me panicking .

Ideally I would like some repesentation to help me but with Dial being the only help locally that might not happen so what id like to know is - is there any way of finding help local to me that you know of ? like a register of approved solicitors or something like that ?

Also if for any reason I don't attend what would happen ? would the tribunal just do a paper hearing ?

Sorry if these questions have been asked before by someone else etc , im just getting more worried each day as things get nearer and im worried about going by myself.

Do an internet search for "welfare advice" with your postcode, town or county, so can also try any charities that specialise in your conditions, however you may struggle to find anybody able to attend with you given where you are in the process.

If you don't attend then the Judge does have the option of going ahead without you, it's impossible to say what will happen on the day.

If you are happy that all of the information needed for your appeal has been sent to the Tribunal Service then you do have the option of switching to a Paper hearing that you do not need to go to but this may lessen your chances of success.
