I understand ESA support group is an indefinite award with regular reassessment ? So in effect it isn't indefinite. However, Please can you direct me to the relevant bit of legislation that actually says "indefinite"

ESA Decisions do not include the length of the award, so you won't find the word "indefinite" in the ESA legislation, as an indefinite award is still an award for a length of time.

We use the word indefinite on the forum because an ESA award continues until it is replaced by a new Decision.

If you can explain why you are looking I may be able to provide more information.

I was getting confused by the use of "indefinite " ....
So it's not indefinite but rather for a maximum of three years only or reassessment unless otherwise stated . (Notwithstanding current backlogs!)

I'm sorry but no!

It is however long it is between Decisions, that is a minimum of three months, but there is no maximum period, it is all down to DWP policy.

At the moment DWP policy is that the maximum period for the WRAG is two years and for the SG it is three years.

But to stress, if no new Decision is made at the end of these periods then the award continues.

Thank you Gordon, I think that's what I'm trying to get at. Where does it actually state this in DWP policy ?

Unfortunately most DWP policy is not in the Public Domain.
