The Tribunal panel can accept any evidence that they wish but given that most hearing are 40-50 minutes they may not have an interest in hearing the tapes, panels are far more interested in hearing the claimant explain why they meet the criteria for an award than looking at issues with the assessment.

If you want to draw their attention to parts of the assessment then you could provide a transcript of that section of the tape rather than the whole thing.

I see, so it's more of a deterrent for lying assessor's then. Well, piece of mind is worth it I guess. So I don't need to get a professional transcription then, I can do it myself and the tribunal will accept that?

Also, I explained how my partner struggles to get to his GP for appointments and he's been registered there for 17 years. The lady at ATOS I spoke to was very understanding and cancelled the 17th August appointment and requested a home visit!

Hi Hayley, I'm very glad that your partner was granted a home assessment without the kind of battle that many of our members endure!

I have never heard of a claimant being asked to provide some sort of professionally sourced transcript. The fact that the original is available if they want verification should be enough.

Thanks Mrs Hurtyback! I'm not sure if he's actually been granted one, the lady I spoke to said she would request one and they'd be in touch within 3 days, I hope that means they'll give him one at home but I didn't take it as confirmation... should I have? :blink:

The only thing now is to work out how my partner meets any of the going out descriptors. The one that applies was cancelled out earlier this yeah because of psychological distress (12 points, needs accompanying by someone to go anywhere).

Now we're stuck between two descriptors. One where he needs prompting (he can't go out alone, prompted or not, I have to go with him) and one where he can't go out at all. Neither are accurate but my partner can't go out more than once or twice a month at the most due to his anxiety. I have to go with him to prevent him panicking to the point of having more severe symptoms. I'm going to argue can't doesn't mean never and appeal if they try and give him the "needs prompting" descriptor, because that's the least accurate. Still sad really, because prior to that change earlier this yeah, the 12 point descriptor is exactly how he is. :(

Great news about the transcript, I'll report back if it ever comes to that, hoping it doesn't but I also know how their system works. ;)

Hi Hayley,

Sorry that I misunderstood about the home assessment - let's hope you get a positive reply soon!

Have a really good look at our PIP guide so that you are sure you completely understand the descriptors you want to argue.

I must've read through it more times than I can count by now, it's been a big help in filling out the form, thank you. :)

The problem really is as I said. The descriptor that applies most accurately was blocked from applying to people with suffer psychological distress - in that he can go out but only if I accompany him. It does exhaust him mentally though so we limit his going out so we'll be arguing for the closest one that applies, can't go out due to anxiety/distress (10 points). Shouldn't have to though, just because they wanted to throw the mentally ill off of Mobility component. :(

Still waiting for their call, it'll either be tomorrow or Monday if they're not open Saturdays at this rate. Hopefully it's good news. :) Thanks for the kind words!
