I just wanted to check something I've read in the appeal/MR guides please;

My MR is supposed to be in by tomorrow but due in part to waiting on a couple of reports though mostly because of the effect this has all had on me, (not helped by DWP keep phoning trying to discourage my MR then change dates for when it needs to be in, i.e., that it should have been in 2 weeks after the date of the decision letter!), it's taking me longer than I expected to finish my MR letter to the point that I should be finished today but not in time for the post. As I (rightly or wrongly) only requested my MR by phone, if I send my MR request letter in saying that further info/evidence will be sent shortly, are the guides still right that they'll allow some extra time for the info/evidence to arrive? I hope that all makes sense?

I'm not entirely sure from your post whether you have formally requested an MR or not.

If you haven't then your request needs to be with the DWP no later than one month after the date on the Decision Letter.

If you have made the request, even by phone then they should give four weeks to submit any additional evidence, again this is for them to have it. You need to have informed them that you would be sending additional information.

I've only made the request for a MR by phone though I have told them that I have further evidence to send in. My one month deadline for requesting a MR is tomorrow - my decision letter is dated the 08.07.17 & the first 2 DWP agents I spoke to both said I had until 08.08.17 to request a MR.

Basically I've been struggling putting everything together for my MR (due to my health issues & the effect this added stress is having on me) so what I was wondering is, if I get my formal MR request letter to them by tomorrow (with a phone call today to say that it's been posted next-day delivery), where I also confirm that additional evidence is on its way, will they allow the extra time for the evidence to arrive? I read in the guides that they'll allow up to 4 weeks (I only need an extra day)?

I hope that makes a bit more sense?

Unless there were reasons why they would not accept your MR when made on the phone, then you should have already classed as having requested one.

If the date on the Decision Letter was 8 July then your request, if not already accepted by phone, needed to be with the DWP today (7 August).

So do you know whether the DWP accepted your telephone request? If they didn't then you need to make a Late request, this requires you to explain why the request is outside of the normal one month.

I've just phoned the PIP dept & spoken to an agent there. Yes my telephone MR was definitely accepted.

I explained my situation & that further evidence was definitely on its way but due to one report that had only just arrived then it would be tomorrow before I could get all of my evidence in the post but like everything else it would be sent next-day delivery. The agent I spoke to said he'd make a note of it on the system so that the DM who's been calling me can see that I've called today to confirm everything is on it's way.

Interestingly the name of the DM I've been told today is a very different name to the one she gave me on the two occasions that she called! I've read in your guides about "the games" that the DWP play but this is the first time that I've knowingly been on the receiving end of them :( What bothers me most is that the 2 agents I spoke to about requesting a MR both gave me tomorrow as my cut off date, the DM who last called me on Friday told me that she was already giving me extra time as everything should have been in when she called me the week before (when she tried to discourage me from requesting a MR!)! I just hope that she honestly goes through everything for my MR!!
