Hi everyone! I wonder if anyone can clarify something for me? I have been claiming ESA and PIP for several years: ESA support group and PIP higher rate mobility and standard rate care. Unbelievably I was run over by a car, eight months ago, and was very seriously injured. Naturally I have logged a compensation claim against the driver of the vehicle. Although I am less mobile now than before this accident it has not changed the amount of benefit that I receive as I had already been assessed as having quite severe mobility problems and care needs. Does anyone know how a future compensation pay out will affect my existing benefit claim, for instance, will it be subject to compensation recovery unit deductions. Also does any one have any experience or knowledge of personal injuries trusts; how to open one, how to manage one etc. Any advice will be greatly appreciated.
In regards a Trust, get legal advice, the firm helping you with your compensation claim should be able to offer such advice.
The DWP may recover some of your benefits if your receive compensation, it will depend on whether they can show any of your payments are the direct result of the accident, you mention that you were already receiving benefits and that the rates have not changed so you maybe OK.
