Pip - Second Mandatory Reconsideration?

Hello,

This is the first time ive posted so im sorry if this has already been answered elsewhere.
I have been in receipt of pip since a dla transfer in 2014. I had a letter for a review in November 2016 and sent all the paperwork back by the end of December. Following a face 2 face assessment i was advised my pip had been stopped in March this year as i had no points at all. We asked for a mandatory reconsideration and sent further evidence. After a 7 week wait i was then advised 3 weeks ago that i had been awarded 11 points and my pip reinstated. I disagree with some of the descriptors and also the letter had a few mistakes and only one copy of the MR notice so i called to ask how i can appeal with only one copy. They were meant to send this out 2 weeks ago but as it hadn't arrived by yesterday i called again to chase. Ive now been told i can't go to appeal yet as they have to do a second MR? Is this right? I receive pip for mental health (depression, anxiety and PTSD from birth trauma). Any advice would be gratefully received. Many Thanks.

No, you do not have to go through a MR of the MR! You can now progress to appeal, there is a link to the form you need in our PIP guide and the MR process is explained.

Hi Mrs Hurtyback,

Thank you so much for your reply. I thought it was odd but they only sent one copy of the MR notice. The deadline to appeal would be 13th August. The first time i rang they said they would resend the letter with the correct number of notices so i could appeal but when it didn't arrive and i called back they put me through to a case manager. He said as i had 0 points on the award and they changed it at MR i must go to a second MR and have no choice. They have just sent me a letter saying i have til 7th september to send in additional evidence.
Can i just ignore this then and send in an appeal anyway? The case manager said i couldn't do that and would be referred back to them for another MR? Also i only have one copy of the MR they just did? Dont i have to send one to the appeal?

You can carry on to appeal, just because the DWP revised the original Decision in your favour does not mean that you have to complete a second MR.

As to the MR Notice, just take copy of the one you have and send the original with your appeal request.

The PIP Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.
