ESA Tribunal was created by CCapewell
My husband has received his letter for a tribunal after a 10 month wait. His doctor has been signing sick notes for him in the interim. Neither of us are sure we have the strength and reserve to go through the tribunal so was looking for advice. If we don't go and Dr keeps signing sick notes will my husband still get his ESA payment or will it stop if they rule against his claim?

He can switch to a Paper hearing that he does not need to attend, contact the Tribunal Service.

His ESA will only continue if an award is made at the appeal.

Thanks Gordon so just to be clear even if Gp continues to sign sick notes the tribunal could stop his payment? They did initially stop payments but then started to pay the new rate when he submitted sick notes.

The amount he gets now is not the same as he was receiving previously. It's the new basic payment.

I assume that he is currently receiving the ESA Assessment rate while he waits for a hearing.

Unless an award is made then he will not receive any further ESA payments whether a Fit Note is issued or not.
