DLA stopped for mum was created by Wadsworth
Hi
Could you please help unfortunately my mum has Alzheimer's and went into a Nursing home permanently on 10th July before that she was receiving DLA Middle Care and High Mobility.
We had a funding meeting with the council and was advised that the care component would stop but she would continue to receive the Mobility component could you please advise what is correct and what we can do has the DLA have appeared to stop it altogether straight away.

OK this is actually quite complicated as your mother's circumstances can effect what is payable.

If she is self-funding then her payments should continue.

If she is not then;

- Any DLA Care component should cease payment after the person has been in care for 28 days.

- The DLA Mobility component should remain in payment if she is in a Care Home, but will stop after 28 days if she is in a Nursing Home, you describe it as the latter so I would expect the Mobility to stop as well.

mum is classed has needing nursing care but is in the 12 week disregard period so presumably this is why the mobility component has stopped we didn't even get given the 28 day period b4 it stopped
from 2nd October mum will be self funding but this will be offset by the council until we have sold her property then we have to repay any outstanding financial help from the sale of the property.
she will still be in the same nursing home but be classed fully self funded does this mean that her DLA mobility component will automatically be reinstated or do we have to re fill any forms on her behalf if so please advise what to do

Mr Frog

Her being funded by her Local Authority or the NHS prevents payment of her DLA but does not close the claim, so as soon as she is self funding then contact the DWP and they should be able to restart her payments once they have confirmed that it is the case.
