Hi
I'm a bit confused about how the requesting an initial explanation works.

When i phone the DWP to request an explanation of my award, will the operator give it to me there and then or is this something they arrange and for which someone will phone me back ?
If the latter is the case, how long do they usually take to ring back with an explanation ?

So you have already received the DM's Statement of Reasons with the Decision Letter, so they may not be willing to provide additional information!

You can contact the DWP office dealing with your claim and ask for a call back from the DM to discuss your claim further, this should occur within five days if accepted, it's likely that the person you speak to will be unable to tell you whether the call will take place or not, all they can do is lodge the request.

If you haven't heard after the five days then chase the DWP again.

To clarify:
I have received my decision letter and it gives a bullet statement of reasons.

Your PIP guide to appeals says i should now request a ' telephone based explanation' in order to avoid a DWP bad practice of denying or avoiding an MR because i didn't make a request for an explanation first. - I don't want or need the explanation. I just want to follow your guidance to avoid DWP bad practice around MR denials or avoidance. I just want to be clear what to expect when i make that request.

You seem to be saying it may or may not happen. If this is the case, the fact it's logged in my DWP record of phone calls that i requested the explanation should cover me from the MR bad practice ? Or do i need to ensure i actually receive an explanation over the phone

I'm now a bit confused - could you clarify ?

Forgive me but I think you have misunderstood the guide, you do not need to do any of these things in regard your requesting an MR, just send your written request to the DWP office dealing with your claim.

Hi

I'm looking B&W PIP April 17 v26 pdf: Challenge To A Personal
Independence Payment (PIP) Decision - A Guide To Mandatory Reconsiderations and Appeals. The cover indicates a date: January 2017

In 4th section called 'Beware of DWP unfair practices' page 6 and7, it indicates:
Refusing to let you ask for a mandatory reconsideration until you have had a phone call from them to explain the original decision.
Failing to make the phone call to explain the original decision.
Failing to tell you, at the end of the phone call to explain the original decision that you can ask for mandatory reconsideration.

On page 7 under a section called: 'Dealing with unfair practices'
It's slightly confusingly stated, but the guidance seems to assume that i should/will consequently have both sent a MR request in writing and requested a phone call to explain the award, presumably the latter to avoid the unfair practice listed above.

So going back to the thread above,, im still confused as to if you're advising me to undertake precautionary measures to avoid the DWP bad practice or not.

These are things that we have seen the DWP do in the past, that does not mean that they will do them in regard to your claim, but the bottom line is, even if they did, you do not have to do any of these things before you request an MR

All you have to do is write a letter to the DWP office dealing with your claim, headed "Request for Mandatory Reconsideration" with your reasons for the request.
